ORDINANCE NO. BL2016-483

An ordinance amending section 2.44.115 of the Metropolitan Code of Laws to require the Metropolitan Police Department to provide traffic stop reports to the Metropolitan Council.

WHEREAS, in 2006, the Metropolitan Council amended Chapter 2.44 of the Metropolitan Code of Laws to require quarterly and annual crime reports to be submitted to the public safety committee of the Metropolitan Council, pursuant to Ordinance No. BL2006-1261; and

WHEREAS, it is in the best interests of the citizens and residents of Nashville and Davidson County that the Metropolitan Council be further provided reports regarding traffic stops conducted by the Metropolitan Nashville Police Department, including demographic information regarding traffic stop subjects.

THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That section 2.44.115 of the Metropolitan Code of Laws is hereby amended by changing the title of the section from "2.44.115 - Crime reports to be submitted to the metropolitan council.” to “2.44.115 - Crime and traffic stop reports to be submitted to the metropolitan council.”

Section 2. That section 2.44.115 of the Metropolitan Code of Laws is hereby further amended by changing the title of subsection 2.44.115.A from “Quarterly report.” to “Quarterly crime report.”; and by changing the title of subsection 2.44.115.B from “Annual report.” to “Annual crime report.”

Section 3. That section 2.44.115 of the Metropolitan Code of Laws is hereby further amended by adding a new subsection as follows:

C. Annual traffic stop report. On or before March 30 of each year, the police department shall submit an annual traffic stop report to the metropolitan council, which report shall include, but not be limited to:

1. For each “demographic category” as defined in subsection (2) below, a listing by MNPD Precinct and MNPD patrol zone of the following:
a. The total number of traffic stops;
b. The percentage of traffic stops that result in warrantless probable cause searches;
c. The success rate of warrantless probable cause searches, defined as the percentage of such searches that result in the seizure of incriminating evidence of any kind;
d. The percentage of traffic stops that result in warrantless consent searches without probable cause;
e. The success rate of warrantless consent searches without probable cause, defined as the percentage of such searches that result in the seizure of incriminating evidence of any kind;
f. The percentage of traffic stops that result in warrantless “pat down” searches;
g. The success rate of “pat down” searches, defined as the percentage of such searches that result in the seizure of illegal weapons.

2. Each “demographic category” shall be defined by sex, race, and ethnicity. For instance, “White non-Hispanic males,” “Black females,” “Hispanic white females,” etc.

Section 4. This Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
