Metropolitan Council Meeting

The Metropolitan Council met in regular session on this date at 6:30 p.m. in the Metropolitan Courthouse.

The invocation was offered by Councilmember Kristine LaLonde.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

The Minutes of the regular meeting of March 15, 2011, were approved.

- PROPOSED RULES AMENDMENTS -

The Rules-Confirmations-Public Elections Committee recommended deferment of the following proposed amendment to Rule 12 of the Rules of Procedure of the Metropolitan Council:

By deleting said rule and substituting with the following new Rule 12:

12. Zoning public hearings

Public hearings on zoning bills shall be held on the first meeting of each month. The Clerk shall exclude ordinances on public hearing from any other Council meeting, except when required by law to be earlier held. This rule shall not preclude any other matters from being considered on the first meeting of each month other than honorary resolutions as provided in Rule 24.

Mr. Crafton moved to defer the amendment for two meetings, which motion was seconded and adopted by a voice vote of the Council.

The Rules-Confirmations-Public Elections Committee recommended approval of the following proposed amendment to Rule 31 of the Rules of Procedure of the Metropolitan Council:

By deleting the first paragraph in its entirety and substituting with the following new paragraph:

Members of the public may address the Council if either of the following conditions is satisfied: (1) the Council adopts a motion by a two-thirds vote of the Council members present to allow an individual person to address the Council regarding a specific ordinance or resolution at the meeting where such motion is considered; or (2) the Council adopted a motion at a previous Council meeting by a two-thirds vote of the Council members present at such meeting to allow members of the public to address the Council at a single, specifically stated, regular Council meeting regarding a specific ordinance or resolution. If a public hearing is authorized under item (2) above, the Council shall, as a part of the authorizing motion, set the time period for the public hearing and a time limit for individual speakers, as well as such other terms of the public hearing as it shall deem prudent.

Community Education Commission
Appointment of Ms. Heather C. Stewart for a term expiring October 1. 2011. The Rules-Confirmations-Public Elections Committee recommended the appointment and Mr. Adkins moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Employee Benefits Study and Formulating Committee
Appointment of Ms. Dorothy Shell-Berry. The Rules-Confirmations-Public Elections Committee recommended the appointment and Mr. Adkins moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Appointment of Mr. Steve Farner. The Rules-Confirmations-Public Elections Committee recommended the appointment and Mr. Adkins moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Appointment of Mr. Gerald Nicely. The Rules-Confirmations-Public Elections Committee recommended the appointment and Mr. Adkins moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Appointment of Ms. Betty C. Nixon. The Rules-Confirmations-Public Elections Committee recommended the appointment and Mr. Adkins moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Appointment of Mr. Bruce Sullivan. At the request of the nominee, the confirmation was deferred.

Board of Zoning Appeals
Reappointment of Mr. Chris Whitson for a term expiring February 26, 2016.. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Mr. Adkins moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

- BILLS ON PUBLIC HEARING AND THIRD READING -

Without objection Bill Nos. BL2011-860 and BL2011-861 were considered together.

BILL NO. BL2011-860

An ordinance adopting a proposed plan of services for the extension of the boundaries of the Urban Services District to include certain property located along Highway 70 South, all of which is more particularly described herein. The bill was approved by the Planning Commission and Planning, Zoning and Historical Committee.

BILL NO. BL2011-861

An ordinance extending the boundaries of the Urban Services District within the jurisdiction of the Metropolitan Government of Nashville and Davidson County to include certain properties located along Highway 70 South, all of which is more particularly described herein. The bill was approved by the Planning, Zoning and Historical Committee.

Mr. Mitchell requested a hearing from the public on these bills which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and no one came forward to be heard. The President declared the public hearing closed. RESOLUTION NO. RS2011-1534

A resolution removing the members of the Metropolitan Board of Fair Commissioners. The resolution was approved by the Rules-Confirmations-Public Elections Committee. Mr. Crafton moved to defer the resolution to the second meeting in May and refer it to the Codes, Fair and Farmers Market Committee, which motion was seconded and adopted by a voice vote of the Council.

A resolution calling the Metropolitan Board of Equalization into regular session beginning June 1, 2011, and special session beginning June 20, 2011. A resolution approving an extension to a grant agreement from the Metropolitan Development and Housing Agency to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Historical Commission, to perform Section 106 environmental review necessary for development proposals using federal funds to determine potential adverse effects to historic properties in compliance with Section 106 of the National Historic Preservation Act. - MEMORIALIZING RESOLUTIONS -

RESOLUTION NO. RS2011-1582

A resolution opposing any state legislation that would remove or inhibit local government powers of self-governance. The Rules-Confirmations-Public Elections Committee recommend withdrawal. At the request of the sponsor, Mr. Steine moved to withdraw the resolution, which motion was seconded and adopted by a voice vote of the Council.
Without objection, the rules were suspended for consideration of one (1) late resolution.

A resolution recognizing the spirit of national NAACP “We Are One” day of action in Nashville, Tennessee. The resolution was approved by the Rules-Confirmations-Public Elections Committee.
