RESOLUTION NO. RS2011-1596

A resolution authorizing the Metropolitan Department of Law to compromise and settle the Metropolitan Government’s property damage claim against Willie Jeffreys.

WHEREAS, on October 8, 2010, William Pate, an employee of the Metropolitan Nashville Police Department, while operating a Metropolitan Government vehicle in the course and scope of his employment, was proceeding through the intersection of Clarksville Highway and Ed Temple Boulevard when his vehicle was struck in the left side by a vehicle operated by Willie Jeffreys, who failed to yield, resulting in damage to the Metropolitan Government vehicle; and,

WHEREAS, after investigation, the Department of Law believes that the settlement listed in Section 1 is fair and reasonable and in the best interest of the Metropolitan Government and recommends that the Metropolitan Government accept payment in the amount of $8,545.26 as compensation for all damages to Metropolitan Government property.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1: The Metropolitan Department of Law is authorized to compromise and settle its recovery claim against Willie Jeffreys in an amount totaling $8,545.26, which shall be deposited into an appropriate fund and account as determined by the Department of Finance.

Section 2: This resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
