ORDINANCE NO. BL2011-901

An ordinance amending Chapters 17.08, 17.12, 17.16 and 17.40 of Title 17 of the Metro Zoning Code to create a new land use called "Single-Family Cottage Development" and to allow it in all two-family (R) zoning districts, and to make a technical change to Chapter 17.40 pertaining to variances (Proposal No. 2011Z-006TX-001).

AMENDMENT NO. 1
TO
ORDINANCE NO. BL2011-901

Madam President:

I move to amend Ordinance No. BL2011-901 as follows:

1. By amending Section 3 by deleting subsections D.1. Location and D.2 Development Configuration in their entirety and replacing them with the following:

“1. Location. Cottage developments shall be permitted within all two-family (R) districts along existing street(s) within the area of the urban services district (USD) in accordance with the development standards below.
2. Development Configuration. The minimum number of cottage units arranged around a common open space in a cottage development shall be four and the maximum shall be twelve.”

2. By amending Section 3 by deleting the following subsection D.10.d in its entirety and re-lettering the remaining subsection accordingly:

“d. Cottage units shall be constructed of materials that that are consistent with and complement the existing residential character of the area.”

TO

Madam President:

I move to amend Ordinance No. BL2011-901 as follows:

1. By amending Section 3 by deleting subsections D.1. Location in its entirety and replacing it with the following:

“1. Location. Cottage developments shall be permitted within the R6, R8 and R10 two-family (R) districts along existing street(s) within the area of the urban services district (USD) in accordance with the development standards below.
2. By amending Section 3 by deleting the following subsection D.8.c in its entirety and re-placing it with the following:

“c. All required parking shall be located on the Single-family Cottage Development property.”

3. By amending Section 3 by adding the following subsection D.12 as follows and renumbering the remaining subsection accordingly:

“12. Stormwater. Water quantity facilities must be screened from view and may not be located in the front setback or the required open spaces, unless located underground.

Madam President:

I move to amend Ordinance No. BL2011-901 by deleting the phrase “urban services district”, wherein it appears in subsection D.1., and substituting with the phrase “urban zoning overlay district”.

AMENDMENT NO. 4
TO
ORDINANCE NO. BL2011-901

Madam President:

I move to amend Ordinance No. BL2011-901 by amending Section 3 by adding the following provisions at the end of subsection D..:

“Notwithstanding the foregoing, no cottage development shall be permitted on lots in the R6, R8, and R10 two-family districts located within the boundaries of Council Districts 1, 2, 3, 8, 12, 13, 14, 15, 17, 20, 21, 27, 28, 29, 30, 32, 33, and 34 as they existed on August 1, 2011, which boundaries are described in detail as part of Attachment A to Ordinance No. BL2011-901, as amended.”
