RESOLUTION NO. RS2011-1534

A resolution removing the members of the Metropolitan Board of Fair Commissioners.

WHEREAS, Chapter 6 of Article 11 of the Charter for the Metropolitan Government of Nashville and Davidson County provides for a Board of Fair Commissioners (“Fair Board”) to exercise all the powers and perform all the duties imposed on the Fair Board by Chapter 490 of the Acts of Tennessee for 1909 and Chapter 515 of the Private Acts of 2923; and

WHEREAS, the private acts referenced in Section 11.062 of the Metropolitan Charter provide that the Fair Board was established for the purpose of maintaining and operating a fair for the people of Davidson County; and

WHEREAS, the Fair Board has decided to no longer operate a fair on the fairgrounds property, and to only continue operating the fairgrounds expo center until a suitable site has been secured to relocate the expo center; and

WHEREAS, since the Fair Board has voted to stop the one activity it is expressly authorized to hold, the Council has lost confidence in the ability of the board to adequately serve the residents and taxpayers of the Metropolitan Government; and

WHEREAS, Section 11.109 of the Metropolitan Charter authorizes the Metropolitan Council, by a three-fourths vote of the entire membership of the Council, to remove any appointive member of any board or commission established under the provisions of the Charter; and

WHEREAS, as a result of the Fair Board’s decisions concerning the discontinuation of the state fair and the other activities at the fairgrounds property, the Metropolitan Council deems it to be in the best interest of the citizens and taxpayers of the Metropolitan Government of Nashville and Davidson County that the Fair Board members be removed.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. Pursuant to Section 11.109 of the Charter of the Metropolitan Government of Nashville and Davidson County, the Metropolitan Council hereby removes the following members of the Metropolitan Board of Fair Commissioners:

Mr. Alex Joyce
Mr. Charles Sueing
Ms. Katy Varney
Mr. James M. Weaver

Section 2. That this Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
