ORDINANCE NO. BL2011-867

An ordinance approving a construction agreement with CSX Transportation, Inc.

WHEREAS, pursuant to the terms of the construction agreement with CSX Transportation, Inc. (“CSX”), attached to this ordinance as Exhibit A, The Metropolitan Government of Nashville and Davidson County agrees to reimburse CSX for certain expenses it incurs relating to the Metropolitan Government’s incursion on and interference with CSX’s tracks in the course of the Metropolitan Government constructing a new overhead highway bridge for the 28th Avenue extension; and,

WHEREAS, approval of this agreement will benefit the citizens of The Metropolitan Government of Nashville and Davidson County.

NOW, THEREFORE BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The construction agreement between the Metropolitan Government of Nashville and Davidson County and CSX Transportation, Inc., attached hereto as Exhibit A, is hereby approved.

Section 2. Any amendments, renewals, or extension of the terms of the agreement may be approved by resolution of the Metropolitan Council.

Section 3. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
