ORDINANCE NO. BL2011-870

An Ordinance amending Title 6 of the Metropolitan Code related to public notice for open meetings of the Transportation Licensing Commission.

BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Section 6.72.030 of the Metropolitan Code is hereby amended by deleting in its entirety subsection 6.72.030(D)(2) and replacing it with the following:

(D)(2) No such hearing shall be held to review applications for certifications of public convenience and necessity without giving due notice of the time and place of such hearing to each applicant and to all current certificate holders. Additionally, notice shall be given to the general public by posting notice of the hearing on the metropolitan transportation licensing commission home web page at least five days prior to the hearing.

Section 2. That Section 6.80.545 of the Metropolitan Code is hereby amended by deleting the last two sentences of subsection (B)(1) in their entirety and replacing them with the following:

(B)(1) …Such changes shall be made only after a public hearing to occur at a time and place established by the commission and due notice provided prior to the hearing.

Section 3. That Section 6.80.545 of the Metropolitan Code is hereby amended by deleting the second sentence in subsection (D)(2) in its entirety and replacing it with the following:

(D)(2) …The commission shall establish the time and date for the public hearing and shall provide due notice prior to the hearing, giving the time and place of such hearing. …

Section 4. This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
