RESOLUTION NO. RS2011-1594

A resolution approving an agreement between the Tennessee Department of Transportation and the Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Department of Public Works, in which TDOT will install and Public Works will maintain safety improvements, including flashing beacons, on State Route 112, Clarksville Pike from Stevens Lane to State Route 155, Briley Parkway.

WHEREAS, the State of Tennessee, Department of Transportation, has allocated certain funds for safety improvements, including flashing beacons, on State Route 112, Clarksville Pike from Stevens Lane to State Route 155, Briley Parkway Lane under Agreement no. 100016, Pin no. 112966.00, Federal project no. STP-SIP-112(10), and State project no. 19046-3215-94; and,

WHEREAS, the Metropolitan Government of Nashville and Davidson County, in recognition of the benefits to be received from said safety improvements, agrees to provide electricity and maintenance; and,

WHEREAS, Tennessee Code Annotated, Section 12-9-104(a)(2)(b) authorizes the Metropolitan Government of Nashville and Davidson County to enter agreements with the State of Tennessee by resolution.

NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the agreement by and between the Tennessee Department of Transportation and the Metropolitan Government of Nashville and Davidson County for safety improvements on State Route 112, Clarksville Pike, from Stevens Lane to Briley Parkway, Agreement no. 100016, Pin no. 112966.00, Federal project No. STP-SIP-112(10), and State project no. 19046-3215-94, a copy of which agreement is attached, is hereby approved, and the Metropolitan Mayor is authorized to execute the same.

Section 2. That any further amendments to this legislation may be processed by resolution.

Section 3. That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
