ORDINANCE NO. BL2011-876

An ordinance to abandon 596 linear feet of an 8 inch water main and easement and 843 linear feet of an 8 inch sanitary sewer and easement and to accept 640 linear feet of water main with 2 fire hydrant assemblies in properties located at 1220, 1230, 1246, and 1250 Robinson Road and Robinson Road (unnumbered) for Old Hickory Skilled Nursing Facility, and authorizing the execution of the documents to carry out said transaction (Proposal No. 2010M-032ES-001).

WHEREAS, the water and sewer lines and easements, on record in the Department of Water and Sewerage Services and incorporated herein by reference, are no longer being used by the Department of Water and Sewerage Services nor any other public utility; and,

WHEREAS, The Metropolitan Planning Commission approved this mandatory referral No. 2010M-032ES-001 on January 5, 2011 for abandonment and relocation of said lines and easements.

NOW, THEREFORE, BE IT ACCEPTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That The Metropolitan Government of Nashville and Davidson County hereby abandons the lines and easements for the Old Hickory Skilled Nursing Facility, as indicated on Exhibit 1 hereto.

Section 2. That The Metropolitan Government of Nashville and Davidson County hereby accepts the water main and 2 hydrants as indicated on Exhibit 1 hereto.

Section 3. The Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and relocation authorized by this ordinance.

Section 4. Amendments to this legislation shall be approved by resolution.

Section 5: That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
