ORDINANCE NO. BL2011-871

An ordinance approving a wire and cable license agreement with Nashville and Eastern Railroad.

WHEREAS, The Metropolitan Government of Nashville and Davidson County accepted a grant from the State of Tennessee, Department of Transportation (“TDOT”), Pin No. 103495, approved by Resolution No. RS2004-594, which includes funds to improve traffic signal communication and interconnection; and,

WHEREAS, the project requires the installation and maintenance of a new fiber optic cable over the Nashville and Eastern Railroad’s (“NERR”) right-of-way and tracks at milepost VH2.1 near the Murfreesboro Pike and Lafayette Street crossing; and,

WHEREAS, pursuant to the terms of the wire and cable license agreement with NERR, attached to this ordinance as Exhibit A, The Metropolitan Government of Nashville and Davidson County is granted license to construct and maintain a fiber optic cable or similar line over NERR’s right of way and tracks at milepost VH2.1 and agrees to reimburse NERR for certain expenses it incurs relating to the procurement and replacement of the two-way flashing lights with 12 inch LED units at the crossing; and,

WHEREAS, approval of this agreement will benefit the citizens of The Metropolitan Government of Nashville and Davidson County.

NOW, THEREFORE BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The wire and cable license agreement between The Metropolitan Government of Nashville and Davidson County and the Nashville and Eastern Railroad, attached hereto as Exhibit A, is hereby approved.

Section 2. Any amendments, renewals, or extension of the terms of the agreement may be approved by resolution of the Metropolitan Council.

Section 3. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
