ORDINANCE NO. BL2011-868

An ordinance abandoning 190 feet of an 8 inch sanitary sewer line and a 20 foot public utility easement for Centennial Medical Office properties, located at 2216 and 2222 Murphy Road and 334 23rd Avenue North, in connection to Project 10-SL-176, shown on Map 92-11, Parcel 213, 217, 218, and 227, and authorizing the execution of the documents to carry out said transaction (Proposal No. 2010M-028ES-001).

WHEREAS, the abandonment of 190 feet of an 8 inch sanitary sewer line and a 20 foot public utility easement for Centennial Medical Office properties, located at 2216 and 2222 Murphy Road and 334 23rd Avenue North, on record in the department of Water and Sewerage Services and incorporated herein by reference, are no longer being used by the Department of Water and Sewerage Services nor any other public utility; and,

WHEREAS, the Metropolitan Planning Commission approved this mandatory referral No. 2010M-028ES-001 on October 27, 2010 for abandonment of said easements.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Metropolitan Government hereby abandons 190 feet of an 8 inch sanitary sewer line and a 20 foot public utility easement for Centennial Medical Office properties, located at 2216 and 2222 Murphy Road and 334 23rd Avenue North, in connection to Project 10-SL-176, shown on Map 92-11, Parcel 213, 217, 218, and 227, as indicated on Exhibit 1 hereto.

Section 2. The Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonments authorized by this ordinance.

Section 3: That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

I move to amend Ordinance No. BL2011-868 by deleting the street name "Murphy Road", wherein it appears in the caption and in Section 1 of the Ordinance, and substituting with the street name "Murphy Avenue".
