Metropolitan Council Meeting
Tuesday, September 4, 2001


The Metropolitan Council met in regular session on this date at 7:00 p.m. in the Metropolitan Courthouse.

The invocation was offered by Councilmember Phil Ponder.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

BILL NO. BL2001-744

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, Section 17.16.060.B (Uses Permitted with Conditions: Medical Uses-Veterinarian), by establishing a new measure for building bulk and clarifying the standards for boarding of companion animals as an accessory use to veterinary clinics (2001Z-004T), all of which is more particularly described herein. The bill was approved by the Planning Commission. Mr. Lineweaver requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill, and no one came forward to be heard. The President declared the public hearing closed. BILL NO. BL2001-746

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by adding provisions for accessory dwelling units in certain residential districts subject to the Urban Zoning Overlay District (2001Z-002T), all of which is more particularly described herein. The bill was approved by the Planning Commission. Mr. Gentry requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill, and citizens were heard in favor of and in opposition to passage of the bill. The President declared the public hearing closed. Mr. Gentry moved to defer action on the bill, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2001-747

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by modifying certain site plan review requirements for Community Education uses (2001Z-005T), all of which is more particularly described herein. Mr. Lineweaver moved to defer action indefinitely on the bill, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2001-750

An ordinance amending Chapter 17.24 of the Metropolitan Code of Laws relative to landscaping, buffering and tree replacement requirements. The bill was approved by the Planning Commission. Mr. Shulman requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill, and no one came forward to be heard. The President declared the public hearing closed. Mr. Shulman moved to pass the bill on second reading and refer it to the Planning, Zoning and Historical Committee, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2001-765

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from RS10 District to RM4 District property at 934 Massman Drive, south of I-40 (.58 acres), (Proposal No. 2001Z-052G-13), all of which is more particularly described herein. The bill was approved by the Planning Commission. Mr. Derryberry moved to defer action indefinitely on the bill, the bill being requested by Mesfin Mulugeta, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2001-766

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R10 District to RM4 District property at Tulip Grove Road (unnumbered), abutting the south margin of Leesa Ann Lane (5.34 acres), (Proposal No. 2001Z?054G?14), all of which is more particularly described herein. The bill was approved by the Planning Commission. Mr. Brown requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill, and citizens were heard in favor of and in opposition to passage of the bill. An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from RS7.5 District to CL District property at 2415 Brick Church Pike, approximately 400 feet north of Avondale Circle (0.30 acres), (Proposal No. 2001Z-053U-03), all of which is more particularly described herein. An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from CL district to CS district property at 4108 Blevins Road and Blevins Road (unnumbered), (10.25 acres), located abutting the south margin of Blevins Road, west of I-24 and south of Old Hickory Boulevard, (Proposal No. 2001Z-062G-03), all of which is more particularly described herein. The bill was approved by the Planning Commission. Ms. Gilmore requested a hearing from the public on this bill which had been previously advertised. BILL NO. BL2001-799

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by canceling the undeveloped Commercial (General) Planned Unit Development District located abutting the southwest corner of Old Hickory Boulevard and I-24 (10.25 acres), classified within the CL district and proposed for CS district, approved for a 64,800 square foot hotel, a 7,200 square foot restaurant, and a 2,400 square foot convenience sales, (Proposal No. 57-86-P-03), all of which is more particularly described herein. The bill was approved by the Planning Commission. Ms. Gilmore requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill, and no one came forward to be heard. The President declared the public hearing closed. Ms. Gilmore moved to pass the bill on second reading and refer it to the Planning, Zoning and Historical Committee, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2001-800

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from RS20 District to AR2a District a portion of property at 3711 Dickerson Pike at the western terminus of Tuckahoe Drive (15.65 acres), (Proposal No. 2001Z-072G-02), all of which is more particularly described herein. The bill was disapproved by the Planning Commission. Mr. Nollner moved to defer action indefinitely on the bill due to error in the language of the bill, the bill being requested by Sector South Services, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2001-801

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R10 District to IWD District property at 3401 Knight Drive, opposite Green Lane (.37 acres), (Proposal No. 2001Z-089U-03), all of which is more particularly described herein. The bill was approved by the Planning Commission. Mr. Nollner moved to defer action to the public hearing in November, the bill being requested by Jerry W. Smotherman and Linda Joan Smotherman, which motion was seconded and adopted by a voice vote of the Council.

The bill was disapproved by the Planning Commission. Mr. Lineweaver moved to withdraw the bill because of community opposition, the bill being requested by Barge, Cauthen and Associates, which motion was seconded and adopted by a unanimous vote of the Council.

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R8 District to RM15 District property at 3535 Bell Road, approximately 925 feet north of Elm Hill Pike (4.87 acres), (Proposal No. 2001Z-057G-13), all of which is more particularly described herein. The bill was disapproved by the Planning Commission. Mr. Derryberry requested a hearing from the public on this bill which had been previously advertised.
