ORDINANCE NO. BL2001-825

An ordinance abandoning a sewer line and easement encumbering Map 117-14, Parcel 159 (Proposal No. 99M-101U), Project No. 97-SL-33, Green Hills Commons Sewer Line and Easement Abandonment.

WHEREAS, Green Hills Commons, LLC, is the owner of real property encumbered by a sewer line and easement; and,

WHEREAS, Green Hills Commons, LLC, has installed a new sewer line which adequately serves the lots and the neighboring properties; and,

WHEREAS, the sewer line and easement is no longer being used by the Department of Water and Sewerage Services, more particularly described on the plans for Project No. 97-SL-33, Green Hills Commons Sewer Line and Easement Abandonment, on record in the office of the Director of Water and Sewerage Services, said plans are made a part hereof as though copied herein; and,

WHEREAS, the Department of Water and Sewerage Services has no need for the said easement; and,

WHEREAS, The Metropolitan Planning Commission of Nashville and Davidson County has already approved the abandonment of said easement.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That this sewer line and easement shown on Map 117-14, Parcel 159, is declared abandoned, and the below signed are hereby authorized to execute the appropriate instruments to carry out such abandonment.

SECTION 2: That this ordinance take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
