Metropolitan Council Meeting

The Metropolitan Council met in regular session on this date at 6:30 p.m. in the Metropolitan Courthouse.

The invocation was offered by Councilmember Jason Potts.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

The roll was called and the following members were present during the progress of the meeting:

- ELECTIONS AND CONFIRMATIONS -

Metropolitan Action Commission
Appointment of Ms. Zulfat Suara for a term expiring February 2, 2020. The Rules, Confirmations, and Public Elections Committee recommended the appointment. Ms. Haywood moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Community Education Commission
Appointment of Ms. Jennifer Douglas for a term expiring October 6, 2018. Ms. Douglas will fill the unexpired term of Ms. Matia Powell. The Rules, Confirmations, and Public Elections Committee recommended the appointment. Ms. Haywood moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Nashville Education Community and Arts Television Board (NECAT)
Reappointment of Ms. Aqiyla Reed for a term expiring February 5, 2020. The Rules, Confirmations, and Public Elections Committee recommended the appointment. Ms. Haywood moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Metropolitan Transit Authority
Appointment of Ms. Hannah Paramore Breen for a term expiring May 1, 2021. Ms. Breen will fill the unexpired term of Ms. Colleen Hoy. The Rules, Confirmations, and Public Elections Committee recommended the appointment. Ms. Haywood moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Work Release Commission (Nominee of Sheriff Daron Hall)
Reappointment of Father Ed Steiner for a term expiring January 1, 2021. The Rules, Confirmations, and Public Elections Committee recommended the appointment. Ms. Haywood moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Board of Zoning Appeals
Reappointment of Mr. David Taylor for a term expiring February 26, 2022. The Rules, Confirmations, and Public Elections Committee recommended the reappointment. Ms. Haywood moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

RESOLUTION NO. RS2017-590

A resolution exempting City House Corporation located at 1222 Fourth Avenue North, from the minimum distance requirements for obtaining a beer permit pursuant to Section 7.08.090.E. of the Metropolitan Code. Mr. O’Connell requested a hearing from the public on this resolution which had been previously advertised. The President asked if anyone desired to be heard for or against the resolution and no one came forward to be heard. The President declared the public hearing closed. The resolution was approved by the Public Safety, Beer, and Regulated Beverages Committee. - CONSENT AGENDA RESOLUTIONS -

RESOLUTION NO. RS2017-587

A resolution requesting that the Metropolitan Department of Codes Administration seek diverse candidates that are inclusive and representative of Nashville’s local demographics and languages when filling existing vacancies and adding additional personnel to enforce property standards. The resolution was approved by the Codes, Fair, and Farmers Market Committee.

RESOLUTION NO. RS2017-592

A resolution accepting a grant from the Bloomberg Associates Foundation to The Metropolitan Government of Nashville and Davidson County, acting by and through the Office of the Mayor, to provide consultant and assessment assistance in the administration of various City services and programs. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2017-593

A resolution approving an application for a Technology Innovation for Public Safety (TIPS) grant from the U.S. Department of Justice to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Nashville Police Department, to identify targeted precincts where precipitous increases in crime have been reported and develop a data communication plan/system to reduce crime in the targeted areas. The resolution was approved by the Budget and Finance and Public Safety, Beer, and Regulated Beverages Committees.

RESOLUTION NO. RS2017-594

A resolution accepting a Friends of Two Rivers Mansion Grant from the Friends of Two Rivers Mansion to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Nashville Parks and Recreation Department, to provide funding for two part-time employees to provide tours at Two Rivers Mansion during the 2017 Christmas season. The resolution was approved by the Budget and Finance and Parks, Library, and Recreation Committees.

RESOLUTION NO. RS2017-595

A resolution accepting a Friends of Two Rivers Mansion Grant from the Friends of Two Rivers Mansion to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Nashville Parks and Recreation Department, to provide funding for fencing across the front of the Two Rivers Mansion property. The resolution was approved by the Budget and Finance and Parks, Library, and Recreation Committees.

RESOLUTION NO. RS2017-596

A resolution accepting a Friends of Two Rivers Mansion Grant from the Friends of Two Rivers Mansion to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Nashville Parks and Recreation Department, to provide funding for two part-time employees to conduct historic tours at Two Rivers Mansion during June, July, and August 2017. The resolution was approved by the Budget and Finance and Parks, Library, and Recreation Committees.

RESOLUTION NO. RS2017-597

A resolution accepting a grant from the Friends of Two Rivers Mansion to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Nashville Parks and Recreation Department, to provide new signage to be installed near the entrance of the Mansion. The resolution was approved by the Budget and Finance and Parks, Library, and Recreation Committees.

RESOLUTION NO. RS2017-598

A resolution accepting a grant from the Hillsboro-West End Neighborhood Association to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Nashville Parks and Recreation Department, to provide materials and labor for the rehabilitation and restoration of the “Dragon” sculpture in Fannie Mae Dees Park. The resolution was approved by the Budget and Finance and Parks, Library, and Recreation Committees.

RESOLUTION NO. RS2017-599

A resolution accepting a grant from Live Nation to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Nashville Parks and Recreation Department, to provide materials and labor to be used in the construction and installation of security fencing at Ascend Amphitheater. The resolution was approved by the Budget and Finance, Convention, Tourism, and Public Entertainment Facilities, and Parks, Library, and Recreation Committees.

RESOLUTION NO. RS2017-600

A resolution approving Amendment One to a grant from the State of Tennessee, Department of Human Services, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Action Commission, to support the Community Service Poverty Fund. The resolution was approved by the Budget and Finance and Health, Hospitals, and Social Services Committees.

RESOLUTION NO. RS2017-601

A resolution approving Amendment Five to a grant from the U.S. Environmental Protection Agency to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, to fund an ongoing program to protect air quality to achieve established ambient air standards and protect human health. The resolution was approved by the Budget and Finance and Health, Hospitals, and Social Services Committees.

RESOLUTION NO. RS2017-602

A resolution accepting a grant from the Association of Food and Drug Officials to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, to provide training to two staff members to audit program standards of the Metropolitan Public Health Department in conjunction with the 2009 FDA Food Code. The resolution was approved by the Budget and Finance and Health, Hospitals, and Social Services Committees.

RESOLUTION NO. RS2017-603

A resolution accepting a grant from the Association of Food and Drug Officials to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, to fund travel expenses for four food inspectors to attend the FD 312 Special Processes at Retail course to prepare participants to inspect retail and food service establishments. The resolution was approved by the Budget and Finance and Health, Hospitals, and Social Services Committees.

RESOLUTION NO. RS2017-604

A resolution approving Amendment One to an intergovernmental agreement by and between the State of Tennessee, Department of Health, and The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, to provide Child Fatality Review Services in the Sudden Death of the Young (SDY) in children under age 19 investigated by the Medical Examiner’s Office. The resolution was approved by the Budget and Finance and Health, Hospitals, and Social Services Committees.

RESOLUTION NO. RS2017-605

A resolution approving a cooperative agreement between The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, and Alive Hospice, Inc. to provide a Worksite POD for licensed medical employees and other licensed medical professionals specified by the Worksite POD with mass prophylaxis for distribution in the event of a public health emergency. The resolution was approved by the Health, Hospitals, and Social Services Committee.

RESOLUTION NO. RS2017-606

A resolution approving a clinical affiliation agreement between The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, and Lipscomb University to provide clinical experience opportunities for its graduate nursing program students. The resolution was approved by the Health, Hospitals, and Social Services Committee.

RESOLUTION NO. RS2017-607

A resolution approving a business associate agreement between The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, and Centerstone to provide safeguards to prevent the use or disclosure of protected health information. The resolution was approved by the Health, Hospitals, and Social Services Committee.

RESOLUTION NO. RS2017-608

A resolution approving a business associate agreement between The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, and the Mental Health Cooperative to provide safeguards to prevent the use or disclosure of protected health information. The resolution was approved by the Health, Hospitals, and Social Services Committee.

RESOLUTION NO. RS2017-609

A resolution accepting a grant from the State of Tennessee, Department of Labor and Workforce Development, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Nashville Career Advancement Center, to establish programs and services for the Supplemental Nutrition Assistance Program (SNAP) (LW09F171QSNAP17). The resolution was approved by the Budget and Finance and Personnel, Public Information, Human Relations, and Housing Committees.

RESOLUTION NO. RS2017-610

A resolution approving Amendment One to a grant from the State of Tennessee, Department of Labor and Workforce Development, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Nashville Career Advancement Center, to provide reemployment services and eligibility assessment services to help unemployment insurance claimants to return to work faster (LW09P161RESEA17). The resolution was approved by the Budget and Finance and Personnel, Public Information, Human Relations, and Housing Committees.

RESOLUTION NO. RS2017-611

A resolution authorizing the Metropolitan Department of Law to compromise and settle the personal injury claim of Wilma Jean Braden against the Metropolitan Government of Nashville and Davidson County in the amount of $21,000.00, and that said amount be paid out of the Self-Insured Liability Fund. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2017-612

A resolution authorizing the Metropolitan Department of Law to compromise and settle the personal injury claim of Brett A. Clanton and the subrogation claim of State Farm Mutual Automobile Insurance Company against the Metropolitan Government of Nashville and Davidson County in the combined amount of $55,000.00, and that said amount be paid out of the Self-Insured Liability Fund. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2017-613

A resolution authorizing the Metropolitan Department of Law to compromise and settle the personal injury claim of Darryl Grider against the Metropolitan Government of Nashville and Davidson County in the amount of $25,000.00, and that said amount be paid out of the Self-Insured Liability Fund. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2017-614

A resolution authorizing Layman Recording to construct and install an aerial encroachment at 1128 3rd Avenue South for (Proposal No.2017M-008EN-001). The resolution was approved by the Planning Commission, Planning, Zoning, and Historical and Public Works Committees.

RESOLUTION NO. RS2017-618

A resolution requesting the Davidson County Delegation to the Tennessee General Assembly to introduce and enact legislation to increase penalties for the desecration of places of worship or burial under Tenn. Code Ann. §39-17-311. The resolution was approved by the Rules, Confirmation, and Public Elections Committee.

RESOLUTION NO. RS2017-619

A resolution honoring the life of Nashvillian Douglas Selph Henry, Jr., the longest serving member of the Tennessee General Assembly and a Southern statesman and gentleman. The resolution was approved by the Rules, Confirmation, and Public Elections Committee.

A resolution expressing the Metropolitan Council’s support for the Medical Cannabis Access Act, also known as SB 1119/HB 0830, currently pending before the Tennessee General Assembly. Mr. Scott Davis offered a substitute resolution and moved that it be accepted for filing, which motion was seconded and adopted by a voice vote of the Council.

A resolution expressing the Metropolitan Council’s support for the Medical Cannabis Access Act medical cannabis legislation, SB 0803/HB 0495 and SB 1119/HB 0830, currently pending before the Tennessee General Assembly. RESOLUTION NO. RS2017-615

A resolution requesting all officers, department directors, and other heads of all boards, commissions, authorities, and other agencies of Metropolitan Government submitting requests for funds for the ensuing fiscal year for capital improvements to the Director of Finance, as required by the Charter of Metropolitan Government, to submit copies of such requests to the Metropolitan Council at the same time of such submissions to the Director of Finance. The Budget and Finance Committee recommended deferment at the request of the sponsor. Mr. Glover moved to defer the resolution to the second meeting in April, which motion was seconded and approved by a voice vote of the Council.

RESOLUTION NO. RS2017-616

A resolution adopting a policy requiring a limitation on the amount of debt service funds appropriated for the amortization of general service bonds and urban service bonds in the annual operating budget of Metropolitan Government in relation to the total expenditures of the annual operating budget for all purposes. The Budget and Finance Committee recommended deferment at the request of the sponsor. Mr. Glover moved to defer the resolution to the second meeting in April, which motion was seconded and approved by a voice vote of the Council.

RESOLUTION NO. RS2017-617

A resolution requesting that the Metropolitan Nashville Police Department include additional officers, salary increases, and additional police vehicles and motorcycles in the FY2018 budget proposal. The resolution was approved by the Budget and Finance, Personnel, Public Information, Human Relations, and Housing, and Public Safety, Beer, and Regulated Beverages Committees. An ordinance amending Title 6 of the Metropolitan Code of Laws to add a new Chapter 6.33 pertaining to the use of public facilities and property by Presidents and candidates for President of the United States. Upon motion duly seconded, the bill passed first reading and was referred to the Convention, Tourism, and Public Entertainment Facilities Committee by a voice vote of the Council.

BILL NO. BL2017-645

An ordinance amending Section 12.54.210 of the Metropolitan Code of Law to allow alcohol consumption by carriage passengers.
Upon motion duly seconded, the bill passed first reading and was referred to the Convention, Tourism, and Public Entertainment Facilities and Public Safety, Beer, and Regulated Beverages Committees by a voice vote of the Council.

BILL NO. BL2017-646

An ordinance amending Chapter 13.08 of the Metropolitan Code of Laws to add a new section regulating installation and operation of unmanned surveillance devices within the public right of way without prior Metropolitan Council approval. Upon motion duly seconded, the bill passed first reading and was referred to the Personnel, Public Information, Human Relations, and Housing, Public Safety, Beer, and Regulated Beverages, and Public Works Committees by a voice vote of the Council.

BILL NO. BL2017-648

An Ordinance authorizing 21C Nashville Master Tenant LLC to install, construct and maintain underground and aerial encroachments in the right of way located at 221 2nd Avenue North (Proposal No. 2017M-010EN-001). The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Planning, Zoning, and Historical and Public Works Committees by a voice vote of the Council.

BILL NO. BL2017-649

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon existing sewer main and any associated easements for four properties located along Villa Place (MWS Project No. 61-A and Proposal No. 2017M-025ES-001). An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon existing water main and to accept new water main and a fire hydrant for property located at 3354 Bell Road (MWS Project No. 16 WL-206 and Proposal No. 2017M-026ES-001). The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Planning, Zoning, and Historical and Public Works Committees by a voice vote of the Council.

BILL NO. BL2017-651

An ordinance approving a participation agreement between the Metropolitan Government and Centurion Products, Inc., regarding the Centurion Stone development and the right-of-way needed for the construction of Tufting Court. Upon motion duly seconded, the bill passed first reading and was referred to Public Works Committee by a voice vote of the Council.

BILL NO. BL2017-652

An ordinance to amend the Geographic Information Systems Street and Alley Centerline Layer for the Metropolitan Government of Nashville and Davidson County by abandoning a portion of Tufting Court right-of-way and easement (Proposal Number 2017M-005AB-001). The bill was approved by the Planning Commission and Traffic and Parking Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Planning, Zoning, and Historical, Public Works, and Traffic, Parking, and Transportation Committees by a voice vote of the Council.

BILL NO. BL2017-653

An ordinance amending Section 17.16.250 of the Metropolitan Code of Laws to revise the list of acceptable documents establishing owner-occupation (Proposal No. 2017Z-009TX-001). Upon motion duly seconded, the bill passed first reading and was referred to the Planning Commission and Planning, Zoning, and Historical Committee by a voice vote of the Council.

BILL NO. BL2017-654

An ordinance amending Chapters 2.28, 6.04, 7.08, 7.16, 10.48, 11.28, 12.48, 17.04, 17.16.and 17.20 to substitute “place of worship” or “religious institution” for “church”(Proposal No. 2017Z-010TX-001). Upon motion duly seconded, the bill passed first reading and was referred to the Planning Commission and Planning, Zoning, and Historical Committee by a voice vote of the Council.

BILL NO. BL2017-655

An ordinance ratifying Ordinance No. BL2015-1094 which amended Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from OG and RM40 to SP zoning for property located at 109 and 123 Bosley Springs Road, approximately 530 feet west of Harding Pike and located within the Harding Town Center Urban Design Overlay District (13.12 acres), to permit a mixed use development, all of which is described herein (Proposal No. 2013SP-018-001). The bill was approved by the Planning Commission with conditions, disapproved without. Upon motion duly seconded, the bill passed first reading and was referred to the Planning, Zoning, and Historical Committee by a voice vote of the Council.

Without objection, the rules were suspended for consideration of one (1) late ordinance.

BILL NO. BL2017-656

An ordinance naming the Bridge over I-40 / I-65 between 11th Avenue North and 12th Avenue North along the 1100 block of Jefferson Street in honor of Bishop Joseph W. Walker, III. Upon motion duly seconded, the bill passed first reading and was referred to the Public Works and Planning, Zoning, and Historical Committee by a voice vote of the Council.

BILL NO. BL2017-581

An ordinance to amend Title 2 of the Metropolitan Code of Laws to grant full investigative authority to the Metropolitan Auditor in order to allow for independent audits and reviews of all Metropolitan Government departments, boards and commissions as well as the performance of contracts by entities that contract with the Metropolitan Government.
