ORDINANCE NO. BL2017-617

An ordinance authorizing the conveyance of the Metropolitan Government’s interest in the building and parcel of property located at 225 Polk Avenue and repealing BL2016-258 (Proposal Number 2017M-019PR-001).

WHEREAS, the Metropolitan Government owns a portion of the building and parcel of real property (the “Property;” commonly known as the Old Ben West Library) at 225 Polk Avenue, Nashville, Tennessee 37219; and,

WHEREAS, the Property was declared surplus pursuant to BL2014-752; and,

WHEREAS, BL2016-258 approved a purchase and sale agreement contemplating the sale of the property to the Tennessee Education Association (“TEA”), but TEA terminated that agreement in accordance with its terms; and,

WHEREAS, pursuant to the agreement (the “Agreement”) attached to this ordinance as Exhibit 1, the Metropolitan Government proposes to sell and Hastings Architecture Associates, LLC (“Hastings”), proposes to buy the Property for use in connection with Hastings’s business; and,

WHEREAS, it is in the public interest to convey the Metropolitan Government’s ownership interest in the Property to Hastings as contemplated in the Agreement.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. Ordinance number BL2016-258 is repealed.

Section 2. The Agreement is approved, and the Director of Public Property Administration is authorized to convey the Metropolitan Government’s interest in the Property to Hastings as contemplated therein.

Section 3. The Director of Public Property Administration or his designee is further authorized to execute such documents as are customary and necessary to carry out the intent of this ordinance.

Section 4. This Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
