ORDINANCE NO. BL2017-614

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon existing water main, a fire hydrant and easement and to accept new fire hydrants for six properties located along 9th Avenue North, (MWS Project No. 15-WL-171 and Proposal No. 2017M-013ES-001).

WHEREAS, the abandonment of approximately 384 linear feet of existing eight inch water main, a fire hydrant and easement, and the acceptance of two new fire hydrants for six properties located along 9th Avenue North, are needed to construct Project No. 15-WL-171; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2017M-013ES-001 on January 20, 2017, for the abandonment and acceptance of said water main, fire hydrants and easements.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 384 linear feet of existing eight inch water main, a fire hydrant and easement and to accept two new fire hydrants, for six properties located along 9th Avenue North, as shown on Exhibits 1 and 2, which are attached hereto and incorporated by reference.

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
