ORDINANCE NO. BL2017-622

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon an existing water main and easement and to accept a new water main, fire hydrant and easement, for properties located at 2126 Abbott Martin Road, and 3811 and 3813 Hillsboro Pike, (MWS Project No. 16-WL-200 and Proposal No. 2017M-019ES-001).

WHEREAS, the abandonment of approximately 165 linear feet of existing eight inch water main and easement and the acceptance of approximately 27 linear feet of new eight inch water main, a fire hydrant and any associated easement, for properties located at 2126 Abbott Martin Road, and 3811 and 3813 Hillsboro Pike, are needed to construct project number 16-WL-200; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2017M-019ES-001 on February 1, 2017, for the abandonment and acceptance of said water mains, fire hydrant and easements.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 165 linear feet of existing eight inch water main and easement, and to accept approximately 27 linear feet of new eight inch water main, a fire hydrant and any associated easement, for properties located at 2126 Abbott Martin Road, and 3811 and 3813 Hillsboro Pike, as shown on Exhibit 1, which is attached hereto and incorporated by reference.

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
