ORDINANCE NO. BL2017-626

An ordinance amending Section 16.04.110 of the Metropolitan Code of Laws regarding noncompliance with Title 16 and the penalties therefor.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Chapter 16.04 of the Metropolitan Code of Laws be and the same is hereby amended by deleting the provisions of Section 16.04.110 in its entirety and substituting in lieu thereof the following new Section 16.04.110:

16.04.110 - Noncompliance— Stop work order.

A. Upon notice from the director of codes administration that work on any building or structure is being done contrary to the provisions of Chapters 16.04 and 16.28 through 16.56, or in a dangerous or unsafe manner; or upon notice that operation of any building or structure is being conducted contrary to the provisions of Section 17.16.250.E; such work or operation shall be immediately stopped. Such notice shall be in writing and shall be given to the owner of the property or to his agent or to the person doing the work or overseeing the operation, and shall state the conditions under which work or operation may be resumed. When an emergency exists, no written notice shall be required to be given by the director.

Section 2. This Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

AMENDMENT NO. 1

TO

ORDINANCE NO. BL2017-626

Mr. President –

I move to amend Ordinance No. BL2017-626 as follows:

I. By amending Section 1 by deleting it in its entirety and substituting therefore the following:

Section 1. That Chapter 16.04 of the Metropolitan Code of Laws be and the same is hereby amended by deleting the provisions of Section 16.04.110.A in its entirety and substituting in lieu thereof the following new Section 16.04.110.A:

A.
