Metropolitan Council Meeting

The Metropolitan Council met in regular session on this date at 6:30 p.m. in the Metropolitan Courthouse.

The invocation was offered by Will Acuff of Corner to Corner Church.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

- ELECTIONS AND CONFIRMATIONS -

Beer Permit Board
Appointment of Ms. Kia Jarmon for a term expiring October 31, 2019. The Rules, Confirmations, and Public Elections Committee recommended the appointment. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

County Medical Examiner
Appointment of Dr. Feng Li. The Rules, Confirmations, and Public Elections Committee recommended deferment. Mr. Shulman moved to defer, which motion was seconded and approved by a voice vote of the Council.

Farmers Market Board
Appointment of Ms. Priscilla Norman for a term expiring May 5, 2016. Ms. Norman will fill the unexpired term of Ms. Kia Jarmon. The Rules, Confirmations, and Public Elections Committee recommended the appointment. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Metropolitan Action Commission
Appointment of Mr. Joseph Mitchell for a term expiring February 2, 2019. The Rules, Confirmations, and Public Elections Committee recommended the appointment. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Reappointment of Dr. LaVoneia C. Steele for a term expiring February 2, 2019. The Rules, Confirmations, and Public Elections Committee recommended the reappointment. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Appointment of Ms. Monica Vasquez for a term expiring February 2, 2019. The Rules, Confirmations, and Public Elections Committee recommended the appointment. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Appointment of Ms. Lisa Wiltshire for a term expiring March 6, 2019. The Rules, Confirmations, and Public Elections Committee recommended the appointment. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Plumbing Examiners and Appeals Board
Appointment of Mr. David W. Holman for a term expiring March 10, 2018. Mr. Holman will fill the unexpired term of Mr. David Adcox, Jr. The Rules, Confirmations, and Public Elections Committee recommended the appointment. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

A resolution exempting Little Donkey Taqueria located at 1120 Fourth Avenue North, Suite 103, Nashville, TN 37208 from the minimum distance requirements for obtaining a beer permit pursuant to Section 7.08.090.E. of the Metropolitan Code. The resolution was approved by the Public Safety, Beer, and Regulated Beverages Committee. Mr. O’Connell requested a hearing from the public on this resolution which had been previously advertised. An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from OL and RS10 to SP zoning for properties located at 100 and 102 Thompson Lane, approximately 485 feet west of Hartford Drive (3.02 acres), to allow uses permitted under the OR20-A zoning district, all of which is described herein (Proposal No. 2015SP-089-001). The bill was approved by the Planning Commission with conditions, disapproved without. Mr. Freeman requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and no one came forward to be heard. The President declared the public hearing closed. Mr. Freeman moved to pass the bill on second reading, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2016-132

An ordinance amending Title 17 of the Metropolitan Code pertaining to financial institutions and alternative financial services (Proposal No. 2016Z-004TX-001). The bill was approved by the Planning Commission with an amendment. Mr. Syracuse requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and no one came forward to be heard. The President declared the public hearing closed. Mr. Syracuse offered Amendment No. 1 and moved for its adoption, which motion was seconded and adopted by a voice vote of the Council. Mr. Syracuse moved to pass the bill on second reading as amended, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2016-135

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from IR to SP zoning for properties located at 1131 and 1137 4th Avenue South, at the northwest corner of Chestnut Street and 4th Avenue South (5.2 acres), to permit a mixed-use development, all of which is described herein (Proposal No. 2015SP-092-001). The bill was approved by the Planning Commission with conditions, disapproved without. Mr. Sledge requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and no one came forward to be heard. The President declared the public hearing closed. Mr. Sledge moved to pass the bill on second reading, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2016-136

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R6 to MUG-A zoning for property located at 2004 3rd Avenue North, approximately 150 feet north of Dominican Drive (0.19 acres), all of which is described herein (Proposal No. 2016Z-004PR-001).
The bill was approved by the Planning Commission. Mr. Hastings requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and no one came forward to be heard. The President declared the public hearing closed. Mr. Hastings moved to pass the bill on second reading, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2016-137

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from IG to SP zoning for property located at 1400 Adams Street, at the northeast corner of Adams Street and Taylor Street (3.79 acres), to permit a mixed-use development with up to 20,000 square feet of non-residential uses and up to 259 residential dwelling units, all of which is described herein (Proposal No. 2016SP-005-001). The bill was approved by the Planning Commission with conditions, disapproved without. Mr. O’Connell requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and no one came forward to be heard. The President declared the public hearing closed. Mr. O’Connell moved to pass the bill on second reading, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2016-138

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from IWD to MUL-A zoning for property located at 2420 Cruzen Street, approximately 130 feet north of Newsome Street (0.17 acres), all of which is described herein (Proposal No. 2016Z-002PR-001). The bill was approved by the Planning Commission. Mr. Sledge requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and no one came forward to be heard. The President declared the public hearing closed. Mr. Sledge moved to pass the bill on second reading, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2016-139

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R40 to SP zoning for property located at 511 Old Hickory Boulevard, approximately 275 feet west of Copperfield Way (5.43 acres), to permit an assisted care living facility with 68 beds, all of which is described herein (Proposal No. 2015SP-109-001). The bill was approved by the Planning Commission with conditions, disapproved without. Mr. Swope requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and citizens were heard in favor of and in opposition to passage of the bill. The President declared the public hearing closed. Mr. Swope moved to pass the bill on second reading and defer the bill to the first meeting in April, which motion was seconded and approved by a voice vote of the Council.

Without objection, Bill Nos. BL2016-140 and BL2016-141 were considered together.

BILL NO. BL2016-140

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by amending a portion of the Carrolton Station Planned Unit Development Overlay District for property located at 308 Carrolton Station Drive, at the intersection of Una-Antioch Pike and Payne Road South, zoned RM6 (21.61 acres), to require the traffic improvements within Metro Public Works’ December 9, 2004 recommendation (Proposal No. 2004P-004-005). The bill was disapproved by the Planning Commission.

BILL NO. BL2016-141

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by amending a portion of the Carrolton Station Planned Unit Development Overlay District for property located at 308 Carrolton Station Drive, at the intersection of Una-Antioch Pike and Payne Road South, zoned RM6 (21.61 acres), to permit a total of 30 multi-family units where 60 were approved per preliminary PUD revision and final site plan. (Proposal No. 2004P-004-004). The bill was disapproved by the Planning Commission.

Ms. Vercher requested a hearing from the public on these bills which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and citizens were heard in favor of passage of the bills. The President declared the public hearing closed. Ms. Vercher moved to pass the bill on second reading, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2016-142

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from IWD to RM20-A zoning for property located at 805 Cherokee Avenue, approximately 560 feet east of Jones Avenue (0.29 acres), all of which is described herein (Proposal No. 2015Z-100PR-001). The bill was approved by the Planning Commission. Mr. Scott Davis requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and no one came forward to be heard. The President declared the public hearing closed. Mr. Davis moved to pass the bill on second reading, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2016-143

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from IR to R6 zoning for property located at 4603 Kentucky Avenue, approximately 610 feet east of 48th Avenue North (0.36 acres), all of which is described herein (Proposal No. 2016Z-001PR-001). The bill was approved by the Planning Commission. Ms. Roberts requested a hearing from the public on this bill which had been previously advertised. The bill was approved by the Planning Commission. Mr. Kindall requested a hearing from the public on this bill which had been previously advertised. An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from CS to SP zoning for properties located at 5644 and 5648 Franklin Pike Circle, north of Old Hickory Boulevard (0.83 acres), to permit a 6-story hotel of up to 100 rooms, all of which is described herein (Proposal No. 2016SP-006-001). The bill was approved by the Planning Commission with conditions, disapproved without. Ms. Henderson requested a hearing from the public on this bill which had been previously advertised. RESOLUTION NO. RS2016-102

A resolution to amend the existing lease agreement between The Metropolitan Government and the State of Tennessee for the Farmers Market Facility to cede a portion of the leased premises (Proposal No. 2016M-005PR-001). The resolution was approved by the Planning Commission, Budget and Finance, Codes, Fair, and Farmers Market and Planning, Zoning, and Historical Committees.

RESOLUTION NO. RS2016-127

A resolution authorizing Nashville Baseball Development, LLC, c/o Spectrum Properties to construct and install an aerial encroachment at Stockyard Street between 2nd Avenue North and 3rd Avenue North for an elevated pedestrian bridge across Whiteside Avenue (Proposal No.2015M-029EN-001). The resolution was approved by the Planning Commission, Planning, Zoning, and Historical and Public Works Committees.

RESOLUTION NO. RS2016-136

A resolution approving a contract between the Metropolitan Government of Nashville and Davidson County and Tyler Technologies, Inc. to provide an electronic filing system for the Davidson County Chancery Court. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2016-137

A resolution approving Amendment One to a grant from the U. S. Department of Justice to The Metropolitan Government of Nashville and Davidson County, acting by and through the Office of Family Safety, to enable the implementation of a county-wide risk/lethality program, to create and implement a civil/legal advocacy program for order of protection hearings, and to improve the substance and quality of presentations. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2016-138

A resolution approving an application for the Spectator/Creator: Performing Arts for Preschoolers Grant from the Tennessee Arts Commission to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Parks and Recreation, to provide quality enrichment activities to preschool aged children and their caregivers in the form of performing arts workshops. The resolution was approved by the Budget and Finance and Parks, Library, and Recreation Committees.

RESOLUTION NO. RS2016-139

A resolution approving an application for the Smart City Challenge Grant from the U. S. Department of Transportation to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Nashville Mayor’s Office, to identify transportation challenges and needs of citizens, the business community, and government to demonstrate how advanced technologies can be used to address issues with safety, mobility, and climate change in the future. The resolution was approved by the Budget and Finance and Traffic, Parking and Transportation Committees.

RESOLUTION NO. RS2016-140

A resolution authorizing Dismas Charities, Inc. to construct and install an aerial encroachment at 808 Lea Avenue (Proposal No.2016M-003EN-001). The resolution was approved by the Planning Commission, Planning, Zoning, and Historical and Public Works Committees.

RESOLUTION NO. RS2016-141

A resolution authorizing SPFS, Inc. dba Germantown Market, LLC to construct and install an aerial encroachment at 1120 4th Avenue North (Proposal No.2015M-025EN-001). The resolution was approved by the Planning Commission, Planning, Zoning, and Historical and Public Works Committees.

RESOLUTION NO. RS2016-142

A resolution requesting that the appropriate Metropolitan Departments review the possibility of turning vacant Metro-owned buildings into affordable housing in the Davidson County area. The resolution was approved by the Rules, Confirmations, and Public Elections Committee.

RESOLUTION NO. RS2016-143

A resolution approving the election of certain Notaries Public for Davidson County. The resolution was approved by the Rules, Confirmations, and Public Elections Committee.

RESOLUTION NO. RS2016-144

A resolution honoring the life of Dr. Sandra Thomas-Trudo and condemning domestic violence. The resolution was approved by the Rules, Confirmations, and Public Elections Committee.

RESOLUTION NO. RS2016-145

A resolution requesting that the proceeds from the proposed buy-out of the lease for state-owned property at the Farmers Market Facility be directed back to the Farmers Market capital improvements and operating budget. The resolution was approved by the Budget and Finance and Codes, Fair, and Farmers Market Committees.

An ordinance amending Title 5 of the Metropolitan Code pertaining to tax increment financing. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance Committee by a voice vote of the Council.

BILL NO. BL2016-158

An ordinance amending Title 2 of the Metropolitan Code of Laws related to the enforcement of the Metropolitan Codes and reporting requirements. Upon motion duly seconded, the bill passed first reading and was referred to the Codes, Fair, and Farmers Market Committee by a voice vote of the Council.

BILL NO. BL2016-159

An ordinance amending section 2.24.300 of the Metropolitan Code. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance Committee by a voice vote of the Council.

BILL NO. BL2016-160

An ordinance amending Section 7.08.090 of the Metropolitan Code to exempt on-premises beer permit applicants within the urban services district from the minimum distance requirements if the establishment for which a permit is sought is separated by a state or federal highway from any church, school or playground, park, licensed day care center or nursery school or playgrounds, or dwelling for one or two families. Upon motion duly seconded, the bill passed first reading and was referred to the Public Safety, Beer, and Regulated Beverages Committee by a voice vote of the Council.

BILL NO. BL2016-161

An ordinance requiring the Metropolitan Board of Fair Commissioners to refrain from scheduling events or activities scheduled on or after January 1, 2017 until such time as a court of law or the Tennessee Attorney General determines whether the Board is in violation of the Metropolitan Charter or state or federal legislation.
