ORDINANCE NO. BL2016-160

An Ordinance amending Section 7.08.090 of the Metropolitan Code to exempt on-premises beer permit applicants within the urban services district from the minimum distance requirements if the establishment for which a permit is sought is separated by a state or federal highway from any church, school or playground, park, licensed day care center or nursery school or playgrounds, or dwelling for one or two families.

BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Section 7.08.090 A. of the Metropolitan Code is hereby amended by adding, immediately after the fifth sentence which ends: “regardless of any change of ownership.”, the following additional provision:

Provided however, the distance requirements provided herein shall not be applicable to establishments which are: (a) located within the urban services district; (b) selling beer for on-premises consumption only; and (c) separated by any state or federal highway consisting of no less than four lanes of traffic excluding parking lanes, from any church, school or its playground, park, licensed day care center or nursery school or its playgrounds, or dwelling for one or two families.

Section 2. That this Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

AMENDMENT NO. 1
TO
ORDINANCE NO. BL2016-160

Mr. President –

I move to amend Ordinance No. BL2016-160 as follows:

I. By amending Section 1 by deleting it in its entirety and substituting therefore the following:
Section 1. That Section 7.08.090 A. of the Metropolitan Code is hereby amended by adding, immediately after the fifth sentence which ends: “regardless of any change of ownership.”, the following additional provision:

“Provided however, the distance requirements provided herein shall not be applicable to establishments which are: (a) located within the urban services district; (b) selling beer for on-premises consumption only; and (c) separated by a state or federal highway consisting of no less than four lanes of traffic excluding parking lanes, from all churches, schools or its playgrounds, parks, licensed day care centers or nursery schools or its playgrounds, or dwellings for one or two families that are otherwise less than one hundred feet from such establishments.”
