ORDINANCE NO. BL2016-151
An ordinance approving a Lease Agreement by and between The Metropolitan Government of Nashville and Davidson County and the State of Tennessee, and a Sublease Agreement by and between The Metropolitan Government of Nashville and Davidson County and STEM Preparatory Academy (Proposal No. 2016M-002PR-001).
WHEREAS, STEM Preparatory Academy already leases a portion of property from Metro at 1250 Foster Avenue, part of the old TPS property, for the purpose of a middle school; and
WHEREAS, STEM Preparatory Academy desires to utilize a different portion of the TPS property and improvements, commonly known as the Hardison Complex, owned by the State for a certified public charter high school serving ninth through twelfth grade students who reside in South Nashville with an integrated focus on a science, technology, engineering and mathematics curriculum, and
WHEREAS, Metro wishes to lease from the State that portion of the real property which is commonly known as the Hardison Complex, as more particularly described in Exhibit A hereto and which includes both the land and permanent improvements now or hereafter located on the land (the land and the improvements are herein collectively referred to as the “Premises”); and
WHEREAS, Metro wishes to sub-let the Premises commonly known as the Hardison Complex to STEM Preparatory Academy.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. The lease agreement between The Metropolitan Government of Nashville and Davidson County and the State of Tennessee, which is attached hereto and incorporated by reference, is hereby approved and the Directors of the Department of General Services and Public Property Administration are authorized to execute the lease on behalf of the Metropolitan Government.
Section 2. The sublease agreement between The Metropolitan Government of Nashville and Davidson County and STEM Preparatory Academy, which is attached hereto and incorporated by reference, is hereby approved and the Directors of the Department of General Services and Public Property Administration are authorized to execute the sublease on behalf of the Metropolitan Government.
Section 3. Any amendment, change, or extension to the lease or sublease shall be approved by resolution of the Metropolitan Council receiving twenty-one affirmative votes.
Section 4. That the Director of Department of General Services shall have authority to approve any and all renovation and/or improvement projects presented by and for STEM Preparatory Academy.
Section 5. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County, Tennessee, requiring it.
