ORDINANCE NO. BL2016-163
An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon an existing sewer main and easement and to accept new sewer mains, manholes, new water mains and fire hydrants, and to negotiate and accept temporary and permanent easements for property located at 1414 Rosebank Avenue (MWS Project Nos. 15-SL-1 and 15-WL-1 and Proposal No. 2015M-059ES-001).
WHEREAS, the abandonment of approximately 443 linear feet of sewer main and easement and the acceptance of 230 linear feet of eight inch DIP sewer main, 616 linear feet of eight inch PVC sewer main, 12 sewer manholes, 918 linear feet of eight inch DIP water main, 74 linear feet of six inch water main, 346 linear feet of four inch water main and two new fire hydrants, and the negotiation and acceptance of temporary and permanent easements for the property located at 1414 Rosebank Avenue, are needed to construct project numbers 15-SL-1 and 15-WL-1; and,
WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2015M-059ES-001 on December 03, 2015, for the abandonment and acceptance of said sewer and water mains, manholes, fire hydrants and easements.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 443 linear feet of sewer main and easement and to accept of 230 linear feet of eight inch DIP sewer main, 616 linear feet of eight inch PVC sewer main, 12 sewer manholes, 918 linear feet of eight inch DIP water main, 74 linear feet of six inch water main, 346 linear feet of four inch water main and two new fire hydrants, and to negotiate and accept temporary and permanent easements, for the property located at 1414 Rosebank Avenue as shown below and on Exhibit 1, which is attached hereto and incorporated by reference:

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this ordinance.
Section 3. Amendments to this legislation shall be approved by resolution.
Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
