RESOLUTION NO. RS2016-145

A resolution requesting that the proceeds from the proposed buy-out of the lease for state-owned property at the Farmers Market Facility be directed back to the Farmers Market capital improvements and operating budget.

WHEREAS, in 1995, the Metropolitan Government of Nashville & Davidson County and the State of Tennessee entered into a Lease Agreement for the Farmers Market facility, constructed adjacent to the Bicentennial Mall; and

WHEREAS, Resolution No. R95-1660 provided that any further amendment to the Lease Agreement must be approved by a resolution of the Metropolitan Council which receives at least twenty-one affirmative votes; and

WHEREAS, Amendment One to the Lease Agreement was enacted pursuant to Resolution No. RS2009-606; and

WHEREAS, pursuant to Resolution No. RS2016-102, the parties to the Lease Agreement have now proposed Amendment Two to the Lease Agreement which would cede the northern tract of the Leased Premises back to the State of Tennessee in return for four (4) million dollars, and

WHEREAS, since its inception on the town square of Nashville in the early 1800’s, the Nashville Farmers Market has been a vital part of Nashville life; and

WHEREAS, the continued economic vitality and operational capacity of the Farmers Market is of utmost significance to the public and to the members of the Metropolitan Council of Nashville & Davidson County, Tennessee; and

WHEREAS, it is therefore fitting and proper that the Metropolitan Council direct the proceeds of the Lease Agreement Amendment Two back toward the capital improvements and operational budget of the Farmers Market.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Metropolitan County Council hereby goes on record as requesting the Metropolitan Government of Nashville & Davidson County direct the four (4) million dollar proceeds from the buy-out of the lease of the state-owned property at Farmers Marker back to the Farmers Market Facility’s capital improvements and operating budget.

Section 2. The Metropolitan Clerk is directed to send a copy of this Resolution to the Mayor, the Davidson County Delegation of the Tennessee General Assembly, and to Tasha Kennard, director of the Farmers Market.

Section 3. This Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
