SUBSTITUTE ORDINANCE NO. BL2016-99
An ordinance amending Chapter 2.132 of the Metropolitan Code of Laws by eliminating the term limits of members of the Metropolitan Human Relations Commission.
WHEREAS, Metropolitan Code of Laws § 2.132.030 limits members of the Metropolitan Human Relations Commission to, at most, two consecutive three-year terms; and
WHEREAS, the effect of a commissioner filling a partial term is not explicitly addressed; and
WHEREAS, modifying the provisions to specify how the service of a partial term should be accounted for would provide clarity for the commission.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. Section 2.132.030 of the Metropolitan Code is hereby amended by deleting the following phrase:
“and may be reappointed for another term after which the member shall not be reappointed for at least one year.”
and replacing it with the following:
“A commission member is not eligible to be reappointed to the commission if such member has served more than one-half of a three year term and a consecutive complete three year term.”
Section 2. This ordinance shall apply to any member of the Metropolitan Human Relations Commission whose term expires after the effective date of this ordinance.
Section 3. This ordinance shall take effect from and after its passage, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
