ORDINANCE NO. BL2016-130

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon an existing water main and to accept a new water main, fire hydrant, and permanent easements for property located at 101 Terminal Court, (MWS Project No. 15-WL-128 and Proposal No. 2016M-003ES-001).

WHEREAS, the abandonment of approximately 140 linear feet of existing four inch DIP water main and the acceptance of approximately 178 linear feet of eight inch DIP water main, one fire hydrant assembly, and permanent easements for a property located at 101 Terminal Court are needed to construct project number 15-WL-128; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2016M-003ES-001 on December 31, 2015, for the abandonment and acceptance of said water mains, fire hydrant assembly, and permanent easements.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 140 linear feet of existing four inch DIP water main and to accept approximately 178 linear feet of eight inch DIP water main, one fire hydrant assembly and permanent easements for a property located at 101 Terminal Court as shown below and on Exhibit 1, which is attached hereto and incorporated by reference:

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
