ORDINANCE NO. BL2016-126

An ordinance authorizing the acquisition of property by negotiation or condemnation for use in a public project for The Metropolitan Government of Nashville and Davidson County and specifically with relation to the expansion of the Martin Luther King Junior Academic Magnet for the use and benefit of the Metropolitan Nashville Public Schools (Proposal No. 2016M-001PR-001).

WHEREAS, Section 2.01 (5) of the Charter of The Metropolitan Government of Nashville and Davidson County grants to such government the power to “…purchase…or otherwise acquire …property… for any public purpose”; and,

WHEREAS, Section 2.01 (6) of the Charter of The Metropolitan Government of Nashville and Davidson County authorizes the government “to establish, maintain and regulate…a system of free schools”; and,

WHEREAS, it is in the public interest that certain property, identified as Parcel 370.00 and Parcel 007.00 on Tax Map 092.08, be acquired through negotiation or condemnation for the expansion of the Martin Luther King Junior Academic Magnet; and,

WHEREAS, the Metropolitan Board of Education approved the acquisition of said property; and,

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY, TENNESSEE:

Section 1. The Director of Public Property Administration, or his designee, is hereby authorized to accept the property as attached in Exhibit A.

Section 2. All property rights herein authorized to be acquired shall be paid from funds authorized from Business Unit No. 80404416.

Section 3. The Director of Public Property Administration, or his designee, is hereby authorized to accept said property title, in the form of a warranty deed.

Section 4 This Ordinance shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson requiring it.
