ORDINANCE NO. BL2016-148

An ordinance amending the application requirements of Section 6.75 of the Metropolitan Code of Law, Pedicabs and Pedal Carriages.

WHEREAS, an application for a pedicab driver’s permit must be filed for consideration with the Metropolitan Transportation and Licensing Commission, prior to the issuance of a driver’s permit; and,

WHEREAS, pursuant to Section 6.75.120(C)(4), in additional to an application, pedicab permit applicants must provide a copy of a recent drug test result, as well as other documents required by the Metropolitan Transportation and Licensing Commission; and,

WHEREAS, providing a drug test in connection with an application is a costly, inefficient means of determining a driver’s fitness to operate a pedicab due to its temporary reliability; and,

WHEREAS, the Metropolitan Code of Law does not require permit applicants for low speed vehicles or other passenger vehicles for hire to submit a drug test result in connection with their application.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Title 6, Section 6.75.120(C) of the Metropolitan Code of Laws shall be amended by deleting subsection 4 in its entirety.

Section 6. That this Ordinance shall take effect after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
