ORDINANCE NO. BL2016-165

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon existing sewer main and to accept new sewer main and easements for properties located along Lynnwood Boulevard and Abbott Martin Road (MWS Project No. 15-SG-0319 and Proposal No. 2016M-004ES-001).

WHEREAS, the abandonment of approximately 680 linear feet of existing eight inch sewer main and the acceptance of approximately 785 linear feet of eight inch sewer main and easements for properties located at 420B, 422, and 424 Lynnwood Boulevard and on Abbott Road (unnumbered), are needed to construct project number 15-SG-0319; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2016M-004ES-001 on January 25, 2016, for the abandonment and acceptance of said sewer mains and easements.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 680 linear feet of existing eight inch sewer main and to accept approximately 785 linear feet of eight inch sewer main and easements for properties located at 420B, 422, and 424 Lynnwood Boulevard and on Abbott Road (unnumbered), as shown on Exhibits 1 and 2, which are attached hereto and incorporated by reference.

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
