The Metropolitan Council met in regular session on this date at 6:30 p.m. in the Metropolitan Courthouse.

The invocation was offered by Father Philip Breen of St. Ann’s Catholic Church.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

Pursuant to regulations of the Tennessee Comptroller’s Office, when the Metropolitan Government undertakes a draw from one of our two commercial paper programs, the attached report must be submitted to the Metropolitan Council and presented at a meeting of that body before filed with the Comptroller.

As you can see from the attached report, on June 5, 2014, we issued $50 million of General Obligation Commercial Paper. Please find below a link to the City’s Investor Relations Page for additional information: http://www.nashville.gov/Finance/Office-of-the-Treasurer/Debt/Investor-Relations.aspx.

Auditorium Commission
Reappointment of Rev. Rod Glatt for a term expiring June 30, 2017. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Ms. Barry moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Electric Power Board
Reappointment of Mr. Sam Howard for a term expiring July 1, 2019. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Ms. Barry moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Employee Benefit Board
Reappointment of Mr. G. Thomas Curtis for a term expiring June 30, 2017. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Ms. Barry moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

- RESOLUTION ON PUBLIC HEARING -

RESOLUTION NO. RS2014-1140

A resolution exempting Mitchell’s Deli located at 1306B McGavock Pike from the minimum distance requirements for obtaining a beer permit pursuant to Section 7.08.090.E. of the Metropolitan Code. Mr. Anthony Davis requested a hearing from the public on this resolution which had been previously advertised. The President asked if anyone desired to be heard for or against the resolution and no one came forward to be heard. The President declared the public hearing closed. The Public Safety-Beer and Regulated Beverages Committee recommended deferment. Mr. Davis requested a suspension of the rules to allow the resolution to be heard and no objection was made. BILL NO. BL2013-392

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from SP to RS80 zoning for property located at Sawyer Brown Road (unnumbered), approximately 540 feet north of Meadow Lane Drive (39.09 acres), all of which is described herein (Proposal No. 2013Z-008PR-001). The bill was approved by the Planning Commission with conditions, disapproved without. Ms. Weiner moved to defer the bill to the September public hearing, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2014-772

An ordinance amending Chapter 17.16 of Title 17 of the Metropolitan Code, Zoning Regulations to modify the conditions pertaining to lot size, setbacks, street standard, landscaping, and hours of operation for construction/demolition landfills and recycling facilities (Proposal No. 2014Z-015TX-001). The bill was approved by the Planning Commission with an amendment. Ms. Weiner requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and no one came forward to be heard. The President declared the public hearing closed. Ms. Weiner moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2014-787

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by amending the Harpeth Village Commercial Planned Unit Development Overlay District on property located at 8002 Highway 100, approximately 280 feet west of Temple Road, zoned CL (1.12 acres), to permit the construction of a 7,000 square foot automobile service facility where a 3,150 square foot automobile convenience facility with 6 fuel islands and an automatic car wash was previously approved, all of which is described herein (Proposal No. 2005P-008-005).
The bill was approved by the Planning Commission with conditions, disapproved without. Mr. Mitchell requested a hearing from the public on this bill which had been previously advertised. BILL NO. BL2014-817

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by amending the Morgan Park Place Specific Plan district for various properties located along 4th Avenue North, 5th Avenue North and Van Buren Street, between 3rd Avenue North and 5th Avenue North, to amend the caption of BL 2006-1037 to allow a total of 72 residential units where 72 residential units were shown on the preliminary SP plan but where 60 residential units were identified in the original Council Bill, to eliminate condition #2 since a greenway has been constructed and to clarify that all other provisions of BL 2006-1037 remain in place, all of which is described herein (Proposal No. 2006SP-022-002). The bill was approved by the Planning Commission with conditions, disapproved without. Mr. Steine requested a hearing from the public on this bill which had been previously advertised. - CONSENT AGENDA RESOLUTIONS -

RESOLUTION NO. RS2014-1141

A resolution approving the issuance of Public Improvement Revenue Refunding Bonds, Series 2014 by The Sports Authority of The Metropolitan Government of Nashville and Davidson County, authorizing the Metropolitan Government’s execution and delivery of a Supplemental Trust Indenture relating thereto; authorizing the pledge of certain of the Metropolitan Government's revenues as security for the bonds; and authorizing an official statement to be distributed in connection with the sale of the bonds.
The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2014-1142

A resolution appropriating funds from the Fund for Cities of Service, Inc. to The Metropolitan Government of Nashville and Davidson County, acting by and through the Mayor’s Office pursuant to a memorandum of understanding to fund the implementation of Change for Chestnut using impact volunteering as a key strategy. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2014-1143

A resolution accepting a grant from The Frist Foundation, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Arts Commission, to create a mobile website, compatible with all phone applications, Facebook, and other social media, to provide tourists and Nashville residents the opportunity to self-curate arts and cultural sites in Nashville. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2014-1144

A resolution accepting a grant from the State of Tennessee, Department of Children’s Services, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Davidson County Juvenile Court, to provide community-based case management and probation services to children at high risk of state custody. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2014-1145

A resolution approving Amendment Two to a grant from the State of Tennessee, Department of Human Services, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Davidson County Juvenile Court, to establish and enforce federal and state mandated child support program guidelines for children born out of wedlock. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2014-1146

A resolution accepting a grant from the State of Tennessee, Department of Correction, and The Metropolitan Government of Nashville and Davidson County, acting by and through the State Trial Courts, for a Community Corrections Services Grant to divert felony offenders from the Tennessee prison system by providing community supervision and treatment services. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2014-1147

A resolution extending the date pursuant to the provisions of Metropolitan Code § 3.24.020(D), for mandatory utilization of the injury-on-duty medical clinic for the treatment of occupational injuries. The resolution was approved by the Budget and Finance and Personnel-Public Information-Human Resources-Housing Committees.

RESOLUTION NO. RS2014-1148

A resolution approving Amendment Two to a grant from the Greater Nashville Regional Council to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Social Services Commission, to provide meals that meet RDA nutritional guidelines at congregate meal sites, meal delivery services, and transportation to eligible seniors and handicapped residents. The resolution was approved by the Budget and Finance and Health, Hospitals and Social Services Committees.

RESOLUTION NO. RS2014-1149

A resolution accepting a grant from the State of Tennessee, Department of Labor and Workforce Development, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Nashville Career Advancement Center, to establish programs and deliver services to prepare youth for entry into the labor force (LW09P141YOUTH15).
