ORDINANCE NO. BL2014-823

An ordinance authorizing the Metropolitan Government to participate with the Cumberland River Compact to improve water quality in Davidson County by removing the low dam in Richland Creek at McCabe Golf Course.

WHEREAS, pursuant to the terms of the Participation Agreement, attached as Exhibit A, the Metropolitan Government proposes to improve water quality in the Richland Creek area of Davidson County, Tennessee by removing the low dam in Richland Creek at McCabe Golf Course; and,

WHEREAS, this Project is deemed to benefit both the parties and the general community, and Metropolitan Government agrees to pay an amount not to exceed thirty-five thousand dollars ($35,000.00) toward the removal of said low dam.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY.

Section 1. That the Participation Agreement between the Metropolitan Government of Nashville and Davidson County, acting by and through the Department of Parks and Recreation, and the Cumberland River Compact for the purpose of improving water quality in Davidson County, Tennessee, and which is attached hereto as Exhibit A and incorporated by reference, is hereby approved, and the Director of Parks and Recreation is authorized to execute the same.

Section 2. That the thirty-five thousand dollars ($35,000.00) from the Metropolitan Government is available in the Deferred Maintenance Capital Fund No. 40014 (BU 40409014) to pay as a contribution toward the low dam removal in Richland Creek at McCabe Golf Course.

Section 3. That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
