ORDINANCE NO. BL2014-831

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon approximately 190 linear feet of 10 inch public sewer main and existing easement, and to accept approximately 194 linear feet of an eight inch public sewer main for properties located at 105, 107, and 109 16th Avenue South, and at McGavock Street (unnumbered), (MWS Project No. 14-SL-0027 and Proposal No. 2014M-019ES-001).

WHEREAS, the abandonment of approximately 190 linear feet of 10 inch public sewer main and existing easement, and the acceptance of approximately 194 linear feet of eight inch public sewer main for properties located at 105, 107, and 109 16th Avenue South, and at McGavock Street (unnumbered) are needed to construct MWS Project Number 14-SL-0027; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2014M-019ES-001 on May 21, 2014, for the abandonment and acceptance of said sewer mains and easement.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 190 linear feet of 10 inch public sewer main and existing easement, and to accept approximately 194 linear feet of eight inch public sewer main for properties located at 105, 107, and 109 16th Avenue South, and at McGavock Street (unnumbered), as shown on Exhibits 1 and 2, which are attached hereto and incorporated by reference.

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
