RESOLUTION NO. RS2014-1147

A resolution extending the date pursuant to the provisions of Metropolitan Code § 3.24.020(D), for mandatory utilization of the injury-on-duty medical clinic for the treatment of occupational injuries.

WHEREAS, in order for the Metropolitan Government to bear the expense for the treatment of an occupational injury, such treatment shall be obtained by the injured employee in conformity with the provisions of Metropolitan Code § 3.24.020(D); and,

WHEREAS, Ordinance BL2013-526 authorized the establishment of an injury-on-duty medical clinic for the treatment of employees who have sustained occupational injuries; and,

WHEREAS, Metropolitan Code § 3.24.020(D) provides that non-emergency treatment shall be furnished to injured employees at an injury-on-duty medical clinic established by the Metropolitan Government or from a panel of preapproved medical providers established by the Employee Benefit Board, known as the “in-line-of-duty medical treatment network”; and,

WHEREAS, Metropolitan Code § 3.24.020(D) states that after June 30, 2014, or a later date determined by Resolution of the Metropolitan Council, in non-emergency situations, only specialized medical treatment that is not available at the injury-on-duty medical clinic shall be furnished to an injured employee through the in-line-of-duty medical treatment network; and,

WHEREAS, it is in the best interests of the Metropolitan Government and its employees to extend the date after which utilization of the injury-on-duty medical clinic becomes mandatory.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That pursuant to the provisions of Metropolitan Code § 3.24.020(D), after January 1, 2015, in non-emergency situations, only specialized medical treatment that is not available at the injury-on-duty medical clinic shall be furnished to an injured employee through the in-line-of-duty medical treatment network.

Section 2. That this Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
