ORDINANCE NO. BL2014-830

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon approximately 77 linear feet of eight inch public sewer main and easement and to accept one new public sewer manhole for properties located at 301, 307, and 315 8th Avenue South and 300 and 312 9th Avenue South, (MWS Project No. 14-SL-0050 and Proposal No. 2014M-027ES-001).

WHEREAS, the abandonment of approximately 77 linear feet of eight inch public sewer main and easement and the acceptance of one new public sewer manhole for properties located at 301, 307, and 315 8th Avenue South and 300 and 312 9th Avenue South are needed to construct MWS project number 14-SL-0050; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2014M-027ES-001 on May 12, 2014, for the abandonment and acceptance of said sewer main and easement and sewer manhole.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 77 linear feet of eight inch public sewer main and easement and to accept one new public sewer manhole for properties located at 301, 307, and 315 8th Avenue South and 300 and 312 9th Avenue South as shown on Exhibits 1 and 2, which are attached hereto and incorporated by reference.

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
