ORDINANCE NO. BL2014-818

An ordinance amending Title 5 of the Metropolitan Code regarding the approval of grants and the authority of Metropolitan Government departments, boards, and commissions to accept donations.

WHEREAS, Ordinance No. BL2002-1186 provides that all grant awards requiring Metropolitan Council approval may be approved by resolution in order to expedite the process for accepting and appropriating funds from grantors; and

WHEREAS, codification of this authority will ensure that the current process for approval and acceptance of grants is maintained; and

WHEREAS, certain boards, departments, and commissions of the Metropolitan Government currently have the authority to accept donations; and

WHEREAS, Ordinance No. BL2006-1015 provides that all departments, boards, and commissions not already having authority to accept donations may accept donations of less than $5,000 upon approval of the Council by resolution and may accept donations in excess of $5,000 upon approval of the Council by ordinance; and

WHEREAS, in order to streamline the donation acceptance process and reduce the amount of staff time and resources necessary to process donations, it is in the best interests of the Metropolitan Government to authorize all departments, boards, and commissions to accept and expend donations valued at $5,000 or less, and that donations exceeding $5,000 shall require Council approval by resolution.

NOW, THEREFORE BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Chapter 5.04 of the Metropolitan Code is amended by adding the following new Section 5.04.076:

5.04.076. Approval of Certain Grant Contracts.
All grant contracts requiring the approval of the Metropolitan Council may be approved by resolution.

Section 2. That Chapter 5.04 of the Metropolitan Code is amended by adding the following new Section 5.04.100:

5.04.100. Acceptance of Donations.
A. All departments, boards, and commissions of the Metropolitan Government that do not have independent authority to accept donations may accept and expend donations with a value of less than or equal to $5,000, exclusive of donations of real property or interests in real property.

B. All departments, boards, and commissions of the Metropolitan Government that do not have independent authority to accept donations may accept donations with a value greater than $5,000, exclusive of donations of real property or interests in real property, with the approval of the Metropolitan Council by Resolution.

Section 3. That this Ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
