Metropolitan Council Meeting

The Metropolitan Council met in regular session on this date at 6:30 p.m. in the Metropolitan Courthouse.

The invocation was offered by Councilmember Sandra Moore.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

The Minutes of the regular meeting of April 15, 2014, were approved.

Metropolitan Auditor

The President announced that the Council will appoint a Metropolitan Auditor at the next regular meeting of the Council from three candidates recommended by the Audit Committee.

Civil Service Commission
Reappointment of Mr. Michael Allen for a term expiring March 31, 2019. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Ms. Barry moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Board of Equalization
Appointment of Mr. Lynn Cawthorne for a term expiring April 1, 2016. The Rules-Confirmations-Public Elections Committee recommended the appointment and Ms. Barry moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Reappointment of Ms. Jean Harrison for a term expiring April 1, 2016. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Ms. Barry moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Human Relations Commission
Appointment of Mr. Abdishakur Mohamed for a term expiring March 18, 2016. Mr. Mohamed will fill the unexpired term of Mr. Mark Baugh. The Rules-Confirmations-Public Elections Committee recommended the appointment and Ms. Barry moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Board of Parks and Recreation
Appointment of Ms. Jenn Garcia for a term expiring April 30, 2018. Ms. Garcia will fill the unexpired term of Ms. Juliana Cano.
The Rules-Confirmations-Public Elections Committee recommended the appointment and Ms. Barry moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Planning Commission
Reappointment of Mr. Greg Adkins for a term expiring March 31, 2018. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Ms. Barry moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Property Standards and Appeals Board
Appointment of Mr. David Morales for a term expiring April 7, 2018. The Rules-Confirmations-Public Elections Committee recommended the appointment and Ms. Barry moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Public Library Board
Reappointment of Ms. Francie Hunt for a term expiring April 6, 2021. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Ms. Barry moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Social Services Commission

RESOLUTION NO. RS2014-1064

A resolution exempting Portland Brew Coffee located at 2605 12th Avenue South from the minimum distance requirements for obtaining a beer permit pursuant to Section 7.08.090.E. of the Metropolitan Code. The resolution was approved by the Public Safety-Beer and Regulated Beverages Committee. Ms. Allen requested a hearing from the public on this resolution which had been previously advertised. An ordinance amending Section 17.12.030 of Title 17 of the Metropolitan Code, Zoning Regulations, pertaining to the calculation of required street setbacks for residential areas with an established development pattern (Proposal No. 2014Z-011TX-001). Mr. Holleman requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and citizens were heard in opposition to passage of the bill. The President declared the public hearing closed. Mr. Holleman moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2014-731

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by amending Ordinance No. BL2011-949 for the Bar-B-Cutie Commercial Planned Unit Development Overlay District on property located at 5207 Nolensville Pike to permit all uses of CS, excluding certain uses, approximately 120 feet north of Brewer Drive, zoned CS (1.77 acres), all of which is described herein (Proposal No. 158-75P-002). The bill was approved by the Planning Commission with conditions. Ms. Blalock requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and a citizen was heard in favor of passage of the bill. The President declared the public hearing closed. An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from CL to CS zoning for properties located at 7417 and 7421 Old Hickory Boulevard, approximately 2,260 feet west of Interstate 24 (3.02 acres), all of which is described herein (Proposal No. 2014Z-016PR-001). The bill was approved by the Planning Commission. Mr. Hunt requested a hearing from the public on this bill which had been previously advertised. BILL NO. BL2014-734

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R6 to SP zoning for properties located at 1421 Porter Road and Porter Road (unnumbered), approximately 500 feet south of McKennell Drive (0.61 Acres), to permit up to six detached dwelling units, all of which is described herein (Proposal No. 2014SP-013-001). The bill was approved by the Planning Commission with conditions, disapproved without. Mr. Anthony Davis requested a hearing from the public on this bill which had been previously advertised. BILL NO. BL2014-735

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from ORI to SP zoning for properties located at 54, 56, 58, 60, 62 and 64 Music Square West, at the northeast corner of Music Square West and Music Square South (1.43 Acres), to permit a mixture of uses and up to 230 multifamily residential units or redevelopment under the ORI-A zoning district, all of which is described herein (Proposal No. 2014SP-015-001). The bill was approved by the Planning Commission with conditions, disapproved without. Ms. Gilmore requested a hearing from the public on this bill which had been previously advertised. BILL NO. BL2014-737

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by making applicable the provisions of the Lockeland Springs-East End Neighborhood Conservation Overlay District to various properties located along Avondale Drive, Bushnell Street, Eastland Avenue, Lakehurst Drive, Lockland Drive, McEwen Avenue, N. 17th Street, N. 18th Street, Ordway Place, and Rudolph Avenue, south of Eastland Avenue (approximately 26 acres), all of which is described herein (Proposal No. 2014NHC-003-001). An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from RS5 to SP zoning for property located at 612 N. 2nd Street, approximately 285 feet north of Berry Street (0.17 Acres), to permit single-family or detached two-family units, all of which is described herein (Proposal No. 2014SP-009-001). An ordinance amending Sections 17.04.060 and 17.08.030 of the Metropolitan Zoning Code to create and define “auction house”, “flea market”, “beer and cigarette market”, and “grocery store” as new land uses (Proposal No. 2014Z-012TX-001). BILL NO. BL2014-741

An ordinance amending Chapters 17.12 and 17.40 of Title 17 of the Metropolitan Code, Zoning Regulations, pertaining to Floor Area Ratio (FAR) within the Urban Zoning Overlay District, which is more specifically described herein (Proposal No. 2014Z-014TX-001). Mr. Hunt requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and a citizen was heard in opposition to passage of the bill. The President declared the public hearing closed. An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from AR2a to CS zoning for property located at 3515 Pin Hook Road, approximately 2,220 feet south of Mt. View Road (3.11 Acres), all of which is described herein (Proposal No. 2014Z-017PR-001). The bill was approved by the Planning Commission. RESOLUTION NO. RS2014-1065

Resolution authorizing and providing for the issuance and sale of general obligation bond anticipation notes in an amount not to exceed $500,000,000 at any one time in the form of commercial paper of The Metropolitan Government of Nashville and Davidson County; authorizing and providing for one or more dealer agreements, issuing and paying agency agreements, and liquidity facility agreements; and providing for certain other matters related thereto. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2014-1066

Resolution authorizing the issuance, sale and payment of bond anticipation notes in an amount not to exceed $200 million in the form of general obligation extendable commercial paper of The Metropolitan Government of Nashville and Davidson County; authorizing a dealer agreement and issuing and paying agency agreement; and providing for certain other related matters. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2014-1067

A Twenty-Sixth Supplemental Electric System Revenue Bond Resolution supplementing certain resolutions of The Metropolitan Government of Nashville and Davidson County by authorizing the issuance of Electric System Revenue Bonds, 2014 Series A, and Electric System Revenue Refunding Bonds, 2014 Series B, as requested by the Electric Power Board of The Metropolitan Government of Nashville and Davidson County. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2014-1068

A resolution approving an application for a STOP Violence Against Women Program Grant from the State of Tennessee, Department of Finance and Administration, to The Metropolitan Government of Nashville and Davidson County, acting by and through the State Trial Courts, to train employees of the Metropolitan Government and their allies in the criminal and civil justice systems in Davidson County who have any interaction with a domestic or sexual violence victim. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2014-1069

A resolution accepting a grant from Sears to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Nashville Fire Department, for funds to purchase protective gear and rescue equipment. The resolution was approved by the Budget and Finance and Public Safety-Beer and Regulated Beverages Committees.

RESOLUTION NO. RS2014-1070

A resolution accepting a grant from the State of Tennessee, Department of Finance and Administration, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Nashville Police Department, for the Internet Crimes Against Children Unit. The resolution was approved by the Budget and Finance and Public Safety-Beer and Regulated Beverages Committees.

RESOLUTION NO. RS2014-1071

A resolution accepting a People’s Law School Program Grant from the Nashville Bar Foundation to The Metropolitan Government of Nashville and Davidson County, acting by and through the Community Education Commission, to provide a series of free legal classes. The resolution was approved by the Budget and Finance and Education Committees.

RESOLUTION NO. RS2014-1072

A resolution approving a grant application for a grant from the Greater Nashville Regional Council to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Social Services Commission, to provide transportation to eligible seniors and handicapped residents in Davidson County. The resolution was approved by the Budget and Finance and Health, Hospitals and Social Services Committees.

RESOLUTION NO. RS2014-1073

A resolution accepting a grant to The Metropolitan Government of Nashville and Davidson County for the use and benefit of the Metropolitan Nashville Social Services Commission to move the most vulnerable people from the streets into supportive housing.
The resolution was approved by the Budget and Finance and Health, Hospitals and Social Services Committees.

RESOLUTION NO. RS2014-1074

A resolution approving a grant application for a grant from the Greater Nashville Regional Council to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Social Services Commission, to provide meals that meet RDA nutritional guidelines at congregate meal sites and meal delivery services to eligible seniors. The resolution was approved by the Budget and Finance and Health, Hospitals and Social Services Committees.

RESOLUTION NO. RS2014-1075

A resolution approving an application for the Antioch-Pettus Road Acquisition Grant from the State of Tennessee, Department of Environment and Conservation, to The Metropolitan Government of Nashville and Davidson County to purchase land to help meet recreational needs in the southeast quadrant of Davidson County. The resolution was approved by the Budget and Finance and Parks, Library and Recreation Committees.

RESOLUTION NO. RS2014-1076

A resolution accepting a grant from the State of Tennessee, Tennessee State Library and Archives, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Nashville Public Library, to provide access and circulation of special materials formatted for individuals who are hearing impaired. The resolution was approved by the Budget and Finance and Parks, Library and Recreation Committees.

RESOLUTION NO. RS2014-1077

A resolution approving Amendment Six to a grant from Vanderbilt University Medical Center, acting by and through the Vanderbilt Department of Pediatrics, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Parks and Recreation, to collaborate on the Growing Right Onto Wellness (GROW) project to stop obesity in preschoolers before it becomes problematic. The resolution was approved by the Budget and Finance and Parks, Library and Recreation Committees.

RESOLUTION NO. RS2014-1078

A resolution approving an Interlocal Agreement between the State of Tennessee, Department of Transportation and The Metropolitan Government of Nashville and Davidson County, acting by and through its Department of Public Works, for the reimbursement of the Metropolitan Government for expenses incurred for maintenance and repairs of transportation infrastructure damage resulting from the May 1, 2010 floods, PIN 114628.01. The resolution was approved by the Budget and Finance and Public Works Committees.

RESOLUTION NO. RS2014-1079

A resolution to approve the first amendment to the lease agreement between The Metropolitan Government and the Parkway Towers, LLC for office space in the Parkway Towers, 404 James Robertson Parkway, for use by several Metro agencies (Proposal No. 2013M-033PR-02). The resolution was approved by the Planning Commission, Budget and Finance and Planning, Zoning and Historical Committees.

RESOLUTION NO. RS2014-1080

A resolution authorizing Tin Roof Acquisition Company, LLC, Tin Roof III, LLC dba Tin Roof, LMP TR Real Estate to construct and install an aerial encroachment at 316 Broadway (Proposal No. 2014M-004EN-001). The resolution was approved by the Planning Commission, Public Works and Planning, Zoning and Historical Committees.

RESOLUTION NO. RS2014-1081

A resolution approving the election of certain Notaries Public for Davidson County. The resolution was approved by the Rules-Confirmations-Public Elections Committee.

RESOLUTION NO. RS2014-1083

A resolution proclaiming the month of May 2014 as Bike Month in Metropolitan Nashville and Davidson County, and welcoming the Tennessee Bike Summit to Nashville. The resolution was approved by the Rules-Confirmations-Public Elections Committee.

RESOLUTION NO. RS2014-1084

A resolution recognizing the 125th anniversary of the opening of The Hermitage as a Presidential Home and the upcoming Bicentennial of Andrew Jackson’s victory at the Battle of New Orleans. The resolution was approved by the Rules-Confirmations-Public Elections Committee.

RESOLUTION NO. RS2014-1085

A resolution recognizing the 80th anniversary celebration of the Nashville Amateur Radio Club (NARC). The resolution was approved by the Rules-Confirmations-Public Elections Committee.

RESOLUTION NO. RS2014-1086

A resolution recognizing the 15th Annual Mayor’s Youth Summit. The resolution was approved by the Rules-Confirmations-Public Elections Committee. - RESOLUTIONS -

RESOLUTION NO. RS2014-1082

A resolution requesting the Metropolitan Development and Housing Agency to create a redevelopment plan for a portion of Council District 5 and requesting the Industrial Development Board to explore the creation of an economic impact plan for the same area. The Budget and Finance Committee recommended deferment. Mr. Scott Davis moved to defer the resolution, which motion was seconded and adopted by a voice vote of the Council.

Without objection, the rules were suspended for consideration of one (1) late resolution.

RESOLUTION NO. RS2014-1089

A resolution accepting a grant from the State of Tennessee, Department of State, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Davidson County Election Commission, for the lease of 100 Ivotronic Voting Machines for the August and November 2014 elections. The resolution was approved by the Budget and Finance Committee. An ordinance approving an agreement by and between The Metropolitan Government of Nashville and Davidson County, by and through the Metropolitan Nashville Arts Commission, and the WESTAF for archiving public art (Public Art Archive), and authorizing the execution of the same. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance Committee by a voice vote of the Council.

BILL NO. BL2014-749

An ordinance to amend the Geographic Information Systems Street and Alley Centerline Layer for the Metropolitan Government of Nashville and Davidson County by abandoning portions of right-of-way and easements for Alley No. 442 along the eastern property line of Tax Map Parcel No. 10408025000 (Proposal No. 2014M-003AB-001). The bill was approved by the Planning Commission and Traffic and Parking Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Public Works and Planning, Zoning and Historical Committees by a voice vote of the Council.
