ORDINANCE NO. BL2014-743

An Ordinance amending Section 7.08.100 of the Metropolitan Code to reduce the minimum seating capacity for eating establishments to obtain a retailer on-sale beer permit.

WHEREAS, Section 7.08.100 of the Metropolitan Code currently prohibits eating establishments with fewer than twenty-five seats from obtaining a beer permit for on-premises consumption; and

WHEREAS, Section 1200-23-1-.02 of the Tennessee Department of Health rules governing food service establishments, which are enforced by the Metropolitan Health Department, references a seating capacity of sixteen seats as it relates to the installation of toilet facilities for the use of patrons; and

WHEREAS, the minimum twenty-five seating capacity provision in Section 7.08.100 of the Metropolitan Code is not necessary to protect the public health, safety, and welfare; and

WHEREAS, it is fitting and proper that the minimum twenty-five seat capacity to obtain a retailer on-sale beer permit be reduced to a minimum capacity of sixteen seats.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Section 7.08.100 of the Metropolitan Code is hereby amended by deleting the phrase “twenty-five persons” and substituting with the phrase “sixteen persons”.

Section 2. That this Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
