RESOLUTION NO. RS2014-1078

A resolution approving an Interlocal Agreement between the State of Tennessee, Department of Transportation and The Metropolitan Government of Nashville and Davidson County, acting by and through its Department of Public Works, for the reimbursement of the Metropolitan Government for expenses incurred for maintenance and repairs of transportation infrastructure damage resulting from the May 1, 2010 floods, PIN 114628.01.

WHEREAS, the area of The Metropolitan Government of Nashville and Davison County was designated as a Federal Disaster Area as a consequence of the May 2010 floods; and,

WHEREAS, The Metropolitan Government is eligible to receive Federal reimbursement for the expenses which were incurred as a result of repair and restoration of transportation facilities and infrastructure within its jurisdiction; and,

WHEREAS, pursuant to the terms of said Agreement, PIN 114628.01 with the State of Tennessee, Department of Transportation (“TDOT”), attached to this resolution as Exhibit A, TDOT agrees to disburse to The Metropolitan Government the Federal reimbursement, less the agreed match amounts for permanent restoration on Morrow Road, East Thompson Lane, Granny White Pike, Sawyer Brown Road, and various traffic signal cabinets for the total amount of two hundred sixty five thousand eight hundred twenty six dollars and 14/100 ($265,826.14); and,

WHEREAS, pursuant to the terms of said Agreement, PIN 114628.01 with the State of Tennessee, Department of Transportation, attached to this resolution as Exhibit A. The Metropolitan Government’s share of the estimate for permanent restoration is three thousand five hundred seven dollars and 35/100 ($3,507.35); and,

WHEREAS, pursuant to the terms of said Agreement, PIN 114628.01 with the State of Tennessee, Department of Transportation, attached to this resolution as Exhibit A. Metro accepts all permanent restoration completed by The State on Broadmoor Drive, Sawyer Brown Road, Elm Hill Pike at Massman Drive and Old Hickory Boulevard at Barnes Road for the total estimate of two hundred seventy-eight thousand two hundred seventeen dollars and 29/100 ($278,217.29); and,

WHEREAS, Tennessee Code Annotated, Section 12-9-104 authorizes The Metropolitan Government to enter agreements with TDOT by resolution; and,

WHEREAS, approval of this agreement will benefit the citizens of The Metropolitan Government of Nashville and Davidson County.

NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The agreement for PIN 114628.01 between The Metropolitan Government of Nashville and Davidson County and the State of Tennessee, Department of Transportation, attached hereto as Exhibit A, is hereby approved.

Section 2. That the amount of this agreement for PIN 114628.01 be appropriated to the Metropolitan Department of Public Works based on the revenues estimated to be received and any match to be applied.

Section 3. That any amendments to this legislation may be processed by resolution.

Section 4. This resolution shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
