The Metropolitan Council met in regular session on this date at 6:30 p.m. in the Metropolitan Courthouse.
The invocation was offered by Pastor Todd Stevens of Friendship Community Church.
The Metropolitan Council gave the pledge of allegiance to the American Flag.

- ELECTIONS AND CONFIRMATIONS -
Electrical Examiners & Appeals Board
Appointment of Mr. Ken Beckman for a term expiring April 16, 2012. Mr. Beckman will represent the heating & air conditioning industry. The Rules-Confirmations-Public Elections Committee recommended the appointment and Mr. Ryman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.
Emergency Communications District Board
Appointment of Mr. James T. Robertson for a term expiring February 14, 2012. Mr. Robertson will represent School District 1. The Rules-Confirmations-Public Elections Committee recommended the appointment and Mr. Ryman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.
Historic Zoning Commission
Appointment of Mr. Phil Ponder for a term expiring April 1, 2013. Mr. Ponder will represent the Planning Commission. The Rules-Confirmations-Public Elections Committee recommended the appointment and Mr. Ryman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.
Public Library Board
Appointment of Ms. Francie Hunt for a term expiring April 6, 2014. Without objection the confirmation was deferred.
Transportation Licensing Commission
Reappointment of Mr. Duane McGray for a term expiring April 30, 2010. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Mr. Ryman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.
Mr. Ryman moved that at the time of adjournment the Council adjourn to Tuesday, June 10, 2008, at 6:00 pm for the purpose of considering the Capital Improvements Budget (Ordinance No. BL2008-229) on third and final reading, along with any other matters that the President deems appropriate for consideration at that time, which motion was seconded and adopted by a voice vote of the Council.
- BILLS ON PUBLIC HEARING AND SECOND READING -
A bill to be entitled: The Budget Ordinance of The Metropolitan Government of Nashville and Davidson County, Tennessee for Fiscal Year 2009. Mr. Cole requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and citizens were heard in favor of and in opposition to passage of the bill. The President declared the public hearing closed. Mr. Cole moved to pass the bill on second reading and re-refer the bill to the Budget and Finance Committee, which motion was seconded and adopted by a voice vote of the Council.
An ordinance adopting the Capital Improvements Budget and Program 2008-2009 through 2013-2014 for The Metropolitan Government of Nashville and Davidson County as the official Capital Improvements Budget and Program of The Metropolitan Government of Nashville and Davidson County for Fiscal Year 2008-2009. The bill was approved by the Planning Commission and the Budget & Finance Committee. Mr. Cole requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill no one came forward to be heard. The President declared the public hearing closed. Mr. Cole moved to pass the bill on second reading and re-refer the bill to the Budget and Finance and Planning, Zoning and Historical Committees, which motion was seconded and adopted by a voice vote of the Council.

An ordinance amending Chapter 2.176 of the Metropolitan Code to change the rate of the special assessment to be levied on real property within the area of the Gulch Central Business Improvement District. Ms. Gilmore requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and a citizen was heard in favor of passage of the bill. The President declared the public hearing closed. - RESOLUTIONS -
A resolution approving an application for a grant for three fire prevention and awareness programs from the United States Department of Homeland Security to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Nashville Fire Department. The Budget and Finance and Public Safety-Beer and Regulated Beverages Committees recommended withdrawal. Mr. Cole moved to withdraw the resolution, which motion was seconded and adopted by a voice vote of the Council.
A resolution accepting a State Aid Contract from the Tennessee Department of Transportation to The Metropolitan Government of Nashville and Davidson County for the resurfacing of Mt. View Road, Project No. 19-960-8405-04. The resolution was approved by the Public Works Committee; the Budget and Finance Committee recommended deferment. Mr. Duvall moved to defer the resolution, which motion was seconded and adopted by a voice vote of the Council.

An ordinance authorizing the Metropolitan Government to participate with E. Phillips Development, L.L.C., to provide public pressure sewer extension through construction of sewerage pump station and force main for its development at Ravenwood Pumping Station. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance and Public Works Committees by a voice vote of the Council.
An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by cancelling the McCrory Creek Business Park Planned Unit Development located at 851 McCrory Creek Road, 2984 Elm Hill Pike, McCrory Creek Road (unnumbered) and Neilworth Lane (unnumbered), at the northeast corner of Elm Hill Pike and McCrory Creek Road (69.09 acres), zoned CS and approved for 735,000 square feet of office uses, all of which is described here in (Proposal No. 2005P-034G-14). The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Planning, Zoning and Historical Committee by a voice vote of the Council.
An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by cancelling a portion of the Niagara Place Planned Unit Development located at McCrory Creek Road (unnumbered) and Elm Hill Pike (unnumbered), at the end of Niagara Drive (25.08 acres), zoned R10 and approved for 90 single-family lots and proposed for Specific Plan zoning, all of which is described herein (Proposal No.110-84-G-14). The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Planning, Zoning and Historical Committee by a voice vote of the Council.
An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from CS and R10 to SP zoning for the McCrory Creek development located at 559, 635, 637, 761, and 851 McCrory Creek Road, McCrory Creek Road (unnumbered), 2984 and 2998 Elm Hill Pike, Elm Hill Pike (unnumbered), and Neilworth Lane (unnumbered), on the south side of McCrory Creek Road north of I-40 (185.94 acres), zoning to permit 2,700,000 square feet office and retail/commercial space, all of which is described herein (Proposal No. 2008SP-013G-14). The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Planning, Zoning and Historical Committee by a voice vote of the Council.
An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R6, CL and CS to SP zoning properties located at 4412, 4416, and 4424 Bass Avenue and Nolensville Pike (unnumbered), approximately 1,760 feet north of Haywood Lane (2.01 acres), to permit an existing 5,300 square foot auto repair shop, auto sales and repair business in a 3,200 square foot office, and 3 single-family lots and 1 duplex lot, all of which is described herein (Proposal No. 2008SP-012U-12). The bill was approved by the Planning Commission. Mr. Foster offered Amendment No. 1 and moved for its adoption, which motion was seconded and adopted by a voice vote of the Council. Mr. Foster moved to pass the bill on first reading as amended, and referred to the Planning, Zoning and Historical Committee by a voice vote of the Council with Mr. Coleman “Abstaining”.
An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R6 to SP zoning for properties located at 1623 and 1625 7th Avenue North, at the southwest corner of 7th Avenue North and Garfield Street (0.38 acres), to permit the development of 5 single-family detached units, all of which is described herein (Proposal No. 2008SP-016U-08). Upon motion duly seconded, the bill passed first reading and was referred to the Planning Commission and Planning, Zoning and Historical Committee by a voice vote of the Council.

- MEMORIALIZING RESOLUTION -
A resolution requesting the Davidson County Delegation to the Tennessee General Assembly to introduce and enact the necessary legislation to rename Spring Street “Martin Luther King, Jr. Boulevard”. The resolution was approved by the Public Works. Ms. Murray moved to defer the resolution, which motion was seconded and adopted by a voice vote of the Council.
