ORDINANCE NO. BL2008-245

An Ordinance amending Title 17 of the Metropolitan Code, Zoning Regulations, by amending Chapter 17.40 to require all amendments to the official zoning map or zoning regulations to be submitted to the department of law for approval as to form and legality.

BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the codification of Title 17 of the Code of The Metropolitan Government of Nashville and Davidson County, Zoning Regulations, be and the same is hereby amended by amending Chapter 17.40 by adding the following new Section 17.40.075:

"17.40.075. Submission of amendatory ordinances to the department of law.
All ordinances to amend the official zoning map or the zoning code shall be submitted to the metropolitan department of law for approval as to form and legality prior to being filed with the metropolitan clerk."

Section 2. That this Ordinance shall take effect five (5) days from and after its passage and such change be published in a newspaper of general circulation, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

Madam President:

I move to amend Ordinance No. BL2008-245 by amending Section 1 by deleting the following language:

"17.40.075. Submission of amendatory ordinances to the department of law.
All ordinances to amend the official zoning map or the zoning code shall be submitted to the metropolitan department of law for approval as to form and legality prior to being filed with the metropolitan clerk."

and substituting in lieu thereof the following:

"17.40.075. Submission of amendatory ordinances to the department of law.
All ordinances to amend the official zoning map or the zoning code shall be submitted to the metropolitan department of law for review at the time they are filed with the metropolitan clerk. The director of the department of law shall, no later than ten (10) days prior to the date such ordinance is initially set for third reading before the metropolitan council, provide to each member of the metropolitan council and to the director of the council office an opinion as to whether or not the enactment of such ordinance may expose the metropolitan government to any liability for violation of federal, state or local law."
