ORDINANCE NO. BL2008-241

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by applying an Historic Bed & Breakfast Overlay District to property located at 3137 Long Boulevard, approximately 180 feet north of Mason Avenue (0.26 acres), zoned RM40 and located within the 31st and Long Boulevard Urban Design Overlay District, all of which is described herein (Proposal No. 2008Z-057U-10).

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Title 17 of the Code of Laws of The Metropolitan Government of Nashville and Davidson County, is hereby amended by changing the Official Zoning Map for Metropolitan Nashville and Davidson County, which is made a part of Title 17 by reference, as follows:

By applying an Historic Bed & Breakfast Overlay District to property located at 3137 Long Boulevard, approximately 180 feet north of Mason Avenue (0.26 acres), zoned RM40 and located within the 31st and Long Boulevard Urban Design Overlay District, as being Property Parcel No. 136 as designated on Map 104-02 of the Official Property Identification Maps of The Metropolitan Government of Nashville and Davidson County, all of which is described by lines, words and figures on the attached sketch, which is attached to and made a part of this ordinance as though copied herein.

Section 2. Be it further enacted, that the Metropolitan Clerk is hereby authorized and directed, upon the enactment and approval of this ordinance, to cause the change to be made on Sheet No. 104 said Official Zoning Map for Metropolitan Nashville and Davidson County, as set out in Section 1 of this ordinance, and to make notation thereon of reference to the date of passage and approval of this amendatory ordinance.

Section 3. Be it further enacted, that this ordinance take effect immediately after its passage and such change be published in a newspaper of general circulation, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

AMENDMENT NO. 1
TO
ORDINANCE NO. BL2008-241

Madam President:

I move to amend Ordinance No. 2008-241 by modifying it as follows:

By adding the following new Section 3 and renumbering the following sections of the Ordinance accordingly:

Section 3. Be it further enacted that, the following conditions be completed, bonded or satisfied prior to the issuance of any permits, or specifically required in the condition:

1. Add a note stating that the house is to remain and any exterior work must be approved by the Metro Historic Zoning Commission and the Metro Planning Commission.
2. Submit a landscape plan with evergreen plants that screen the parking from adjacent properties along the rear property line.
3. Add a note stating the maximum number of guest rooms.
4. Trash cans must be accommodated on site and appropriately screened.
5. Add the parking spaces used by the residents to the plan. Label the owner/operator parking and resident parking on the plan.
6. Show utility plan and lighting fixtures for outdoor area.
