RESOLUTION NO. RS2008-333

A resolution authorizing the acquisition of a conservation easement of real property by negotiation to widen part of the Stones River Greenway (Proposal No. 2008M-062).

WHEREAS, it is the intent of the Metropolitan Parks and Recreation Department to construct road improvements along the Stones River Greenway; and,

WHEREAS, Section 2.24.250(F) of the Metropolitan Code of Laws provides:

"Where land in fee simple is being purchased for purposes other than for rights-of-way for highways, streets, roads, alleys and other places for vehicular traffic, the director of public property administration shall negotiate for the purchase of such property and seek to obtain from the owner an option to sell to the metropolitan government at a fixed price, subject to the approval of the metropolitan council by resolution, and no purchase shall be consummated until it has been so approved by the metropolitan council"; and,

WHEREAS, pursuant to section 2.24.250(F) of the Metropolitan Code of Laws, the Director of Public Property Administration has negotiated an option (ATTACHMENT 1) to acquire an easement in real property located in Davidson County as shown on EXHIBIT A and incorporated into this resolution by reference; and,

WHEREAS, it is deemed in the best interest of the Metropolitan Government to approve the acquisition of said property right and dispose of an easement to the grantor.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Director of Public Property is authorized to exercise the option (ATTACHMENT 1) to acquire the property (a portion of Map 085-00-0 Parcel 007.00) as shown in Exhibit A and to execute the necessary documents pertaining thereto.

Section 2. This resolution shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
