ORDINANCE NO. BL2008-210

An ordinance abandoning an 8” sanitary sewer line and easement that will be converted to a Private Service Line in connection with Project 07-SL-0224, West Nashville Heights Church of Christ, shown on Map 102-11, Parcels 003, 004, and 005, 6833 Old Charlotte Pike and 825 Templeton Drive and authorizing the execution of the documents to carry out said transaction (Proposal No. 2008M-003U-7).

WHEREAS, an 8” existing sanitary sewer line and accompanying easement, more particularly described in Project No. 07-SL-0224, West Nashville Heights Church of Christ, on record in the department of Water and Sewerage Services and incorporated herein by reference, are no longer being used by the Department of Water and Sewerage Services nor any other public utility; and

WHEREAS, The Metropolitan Planning Commission approved this mandatory referral No. 2008M-003U-7 on January 15, 2008 for abandonment of said easement and sanitary sewer line.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the Metropolitan Government hereby abandons the 8” sanitary sewer line and the easement that will be converted to a Private Service Line that is shown on Map 102-11, Parcels 003, 004, and 005, Project No. 07-SL-0224 West Nashville Heights Church of Christ as indicated on Exhibit 1 hereto, and the Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment authorized by this ordinance.

SECTION 2: Any further amendments to this Legislation may be processed by Resolution.

SECTION 3: That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
