The Metropolitan Council met in regular session on this date at 6:30 p.m. in the Metropolitan Courthouse.
The invocation was offered by T. Devan Franklin, III of Lake Providence Missionary Baptist Church.
The Metropolitan Council gave the pledge of allegiance to the American Flag.

Cheatham County Rail Authority
The President gave notice of a vacancy on the Cheatham County Rail Authority and announced that an election would be held by the Metropolitan Council at the meeting of June 6, 2017 to fill the two-year term. Deadline for nominations to be submitted in writing to the Metropolitan Clerk is Tuesday, May 9, 2017 at 4:00 p.m.
Nashville and Eastern Rail Authority
The President gave notice of a vacancy on the Nashville and Eastern Rail Authority and announced that an election would be held by the Metropolitan Council at the meeting of June 6, 2017 to fill the two-year term. Airport Authority
Appointment of Mr. Dierks Bentley for a term expiring April 5, 2021. The Rules, Confirmations, and Public Elections Committee recommended the appointment. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.
Reappointment of Mr. Aubrey (Trey) Harwell, III for a term expiring April 5, 2021. The Rules, Confirmations, and Public Elections Committee recommended the appointment. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.
Reappointment of Mr. Robert (Bobby) Joslin, Jr. for a term expiring April 5, 2021. The Rules, Confirmations, and Public Elections Committee recommended the appointment. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.
Emergency Communications District Board
Reappointment of Mr. David Gleason for a term expiring February 14, 2021. At the request of the nominee, the confirmation was deferred.
Board of Parks and Recreation
Appointment of Ms. Tari Hughes for a term expiring April 30, 2022. The Rules, Confirmations, and Public Elections Committee recommended the appointment. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.
Public Library Board
Appointment of Ms. Katy Varney for a term expiring April 6, 2018. Ms. Varney will fill the unexpired term of Mrs. Margaret Ann Robinson. The Rules, Confirmations, and Public Elections Committee recommended the appointment. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.
- BILLS ON PUBLIC HEARING –
Without objection, Bill Nos. BL2017-608, BL2017-609, BL2017-610, BL2017-611, BL2017-653 and BL2017-685 were moved to the heel of the public hearing items to be considered together.
An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from AR2a to IWD zoning for property located at 3920 Stewarts Lane, approximately 3,580 feet south of Ashland City Highway and partially located within the Floodplain Overlay District (10.0 acres), all of which is described herein (Proposal No. 2014Z-049PR-001). The bill was approved by Planning Commission. Mr. Leonardo requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and no one came forward to be heard. The President declared the public hearing closed. Mr. Leonardo moved to pass the bill on second reading and re-refer the bill to the Planning Commission, which motion was seconded and approved by a voice vote of the Council.
An ordinance amending Title 15 and Title 17 of the Metropolitan Code of Laws pertaining to the Department of Water and Sewerage Services (Proposal No. 2016Z-022TX-001). The bill was approved by the Planning Commission with an amendment. Ms. Weiner requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and no one came forward to be heard. The President declared the public hearing closed.
Ms. Weiner moved to pass the bill on second reading and defer the bill to the second meeting in July, which motion was seconded and approved by a voice vote of the Council.
An ordinance amending Chapters 2.28, 6.04, 7.08, 7.16, 10.48, 11.28, 12.48, 17.04, 17.16, and 17.20 to substitute “place of worship” or “religious institution” for “church”(Proposal No. 2017Z-010TX-001). The bill was approved by the Planning Commission. Ms. Weiner requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and no one came forward to be heard. The President declared the public hearing closed. Ms. Weiner moved to pass the bill on second reading, which motion was seconded and approved by a voice vote of the Council.
An ordinance ratifying Ordinance No. BL2015-1094 which amended Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from OG and RM40 to SP zoning for property located at 109 and 123 Bosley Springs Road, approximately 530 feet west of Harding Pike and located within the Harding Town Center Urban Design Overlay District (13.12 acres), to permit a mixed use development, all of which is described herein (Proposal No. 2013SP-018-001). The bill was approved by the Planning Commission with conditions, disapproved without. Ms. Murphy requested a hearing from the public on this bill which had been previously advertised. An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from CS to MUL-A zoning on properties located at 3962, 3968 and 3976 Dickerson Pike and Dickerson Pike (unnumbered), approximately 1,140 feet southwest of Hunters Lane (7.67 acres), all of which is described herein (Proposal No. 2017Z-017PR-001). The bill was approved by the Planning Commission. Ms. Haywood moved to defer the bill indefinitely, which motion was seconded and approved by a voice vote of the Council.
The following items were taken out of order.
An ordinance amending section 17.16.250.E of the Metropolitan Code of Laws to establish a 12-month moratorium on the issuance of new Type 2 and Type 3 short term rental property permits and permit numbers for properties zoned for single and two-family residential use (Proposal No. 2017Z-005TX-001). The Planning Commission recommended withdrawal.
An ordinance to amend Title 17 of the Metropolitan Code, Zoning Regulations, pertaining to Short Term Rental Properties (Proposal No. 2017Z-012TX-001). The bill was disapproved by the Planning Commission.
Mr. Swope moved to withdraw these bills, which motion was seconded and adopted by a voice vote of the Council with Ms. Roberts abstaining.
An ordinance amending section 17.16.250.E of the Metropolitan Code of Laws to establish a 36-month moratorium on the issuance of new Type 2 and Type 3 short term rental property permits for properties zoned for single and two-family residential use. (Proposal No. 2017Z-006TX-001). The Planning Commission recommended withdrawal. Ms. VanReece moved to withdraw, which motion was seconded and adopted by a voice vote of the Council with Ms. Roberts abstaining.

An ordinance amending sections 17.04.060 , 17.08.030, 17.16.250, and 17.16.070 of the Metropolitan Code of Laws to establish distinct land uses for “Short term rental property – Owner-Occupied” and “Short term rental property – Not Owner-Occupied”, and establishing a phase out date in year 2021 for “Short term rental property – Not Owner-Occupied” (Proposal No. 2017Z-004TX-001). The Planning Commission approved the bill with a substitute, disapproved with amendment. Mr. Hagar requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and citizens were heard in favor of and in opposition to passage of the bill. An ordinance making applicable to Metropolitan Government the provisions of Part 7 of Chapter 211 of Title 68 of the Tennessee Code Annotated to require local approval of landfills, solid waste disposal facilities and solid waste processing facilities prior to the construction of such facilities. The bill was approved by the Public Works Committee. Mr. Leonardo moved to pass the bill on third reading, which motion was seconded. After discussion, Mr. Pardue called for the previous question, which motion was seconded and adopted by a voice vote of the Council. - CONSENT AGENDA RESOLUTIONS -
A resolution calling the Metropolitan Board of Equalization (“MBOE”) into regular session beginning June 1, 2017 and special session beginning June 26, 2017. The resolution was approved by the Budget and Finance Committee.
A resolution approving the appointment of hearing officers by the Metropolitan Board of Equalization to conduct preliminary hearing and to make investigations regarding complaints before the Board. The resolution was approved by the Budget and Finance Committee.
