ORDINANCE NO. BL2017-661

An ordinance authorizing a participation and maintenance agreement between The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Department of Water and Sewerage Services, hereinafter known as “METRO,” and DAVENPORT DOWNS HOLDING, LLC, hereinafter known as “OWNER,” to provide public pressure sewer extension through construction of sewerage pump station and force main for its development at Davenport Downs, (Project No. 07-SL-180).

WHEREAS, pursuant to the terms of the participation and maintenance agreement, attached hereto as Exhibit C, OWNER in compliance with all METRO requirements and specifications, has expressed a desire to provide public pressure sewer extension through construction of a sewerage pump station and force main for its development at Davenport Downs, as shown in Exhibits A and B attached hereto, Project No. 07-SL-180; and,

WHEREAS, OWNER agrees to fund the additional operation and maintenance costs of the proposed pump station and force main in the amount of $200,000.00 prior to OWNER filing for final plat approval, or as soon as possible to obtain sewer availability; and,

WHEREAS, METRO will inspect the construction and will be responsible for ongoing operation and maintenance; and,

WHEREAS, the Project is deemed to benefit both parties and the general community.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY.

Section 1. The participation and maintenance agreement (Exhibit C) between The Metropolitan Government of Nashville and Davidson County, acting by and through the Department of Water and Sewerage Services, and OWNER to provide public pressure sewer extension through construction of sewerage pump station and force main for its development at Davenport Downs in Davidson County, Tennessee, attached hereto and incorporated herein, is hereby approved, and the Director of Water and Sewer Services is authorized to execute the same.

Section 2. That the Metropolitan Government is hereby authorized to accept from OWNER the amount of $200,000.00 for the construction, operation and maintenance of the pump station and force main.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
