ORDINANCE NO. BL2017-663

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon existing combined sewer mains and easements and to accept new combined sewer mains, manholes and any associated easements, for property located at 1419 Rosa L. Parks Boulevard (MWS Project Nos. 16-SL-257 and Proposal No. 2017M-029ES-001).

WHEREAS, the abandonment of approximately 225 linear feet of existing 18 inch combined sewer main, approximately 550 linear feet of existing 39 inch combined sewer main, approximately 175 linear feet of 12 inch combined sewer main and easements and the acceptance of approximately 69 linear feet of new 18 inch combination sewer main, approximately 105 linear feet of new 24 inch combination sewer main, 610 linear feet of new 48 inch combination sewer main, 13 combined sewer manholes and any associated easements for property located at 1419 Rosa L. Parks Boulevard, are needed to construct project number 16‑SL-257; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2017M-029ES-001 on March 8, 2017, for the abandonment and acceptance of said combined sewer mains, manholes and easements.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1.        The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 225 linear feet of existing 18 inch combined sewer main, approximately 550 linear feet of existing 39 inch combined sewer main, approximately 175 linear feet of 12 inch combined sewer main and easements, and to accept approximately 69 linear feet of new 18 inch combination sewer main, approximately 105 linear feet of new 24 inch combination sewer main, 610 linear feet of new 48 inch combination sewer main, 13 combined sewer manholes and any associated easements, for property located at 1419 Rosa L. Parks Boulevard as shown on Exhibit 1, which is attached hereto and incorporated by reference.

Section 2.        The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this ordinance.

Section 3.        Amendments to this legislation shall be approved by resolution.

Section 4.        This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
