The Metropolitan Council met in regular session on this date at 6:30 p.m. in the Metropolitan Courthouse.
The invocation was offered by Reverend Curtis Bryant of Greater Heights Missionary Baptist Church.
The Metropolitan Council gave the pledge of allegiance to the American Flag.

Community Corrections Advisory Board
Reappointment of Mr. Kevin R. McGee for a term expiring August 18, 2018. At the request of the appointee, the nomination was deferred.
Convention Center Authority
Appointment of Mr. Randy Rayburn for a term expiring September 30, 2020. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.
Reappointment of Mr. William L. Simons for a term expiring September 30, 2020. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.
Reappointment of Ms. Renata Soto for a term expiring September 30, 2020. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.
Nashville Education Community and Arts Television (NECAT)
Appointment of Mr. Jim Ed Norman for a term expiring February 5, 2019. Mr. Norman will fill the unexpired term of Mr. Michael Hart. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.
Transportation Licensing Commission
Reappointment of Ms. Rhonda Marko for a term expiring October 10, 2018. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.
Reappointment of Mr. Tom Turner for a term expiring October 10, 2018. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

- RESOLUTION ON PUBLIC HEARING-
A resolution exempting Fifty First Kitchen & Bar located at 5104 Illinois Avenue from the minimum distance requirements for obtaining a beer permit pursuant to Section 7.08.090.E. of the Metropolitan Code. Ms. Roberts requested a hearing from the public on this resolution which had been previously advertised. The President asked if anyone desired to be heard for or against the resolution and no one came forward to be heard. The President declared the public hearing closed. The Public Safety, Beer, and Regulated Beverages Committee had no recommendation due to lack of quorum. Ms. Roberts requested a suspension of the rules to allow the resolution to be heard and no objections were made. - BILLS ON PUBLIC HEARING-
An ordinance amending Section 17.40.120 of Title 17 of the Metropolitan Code, Zoning Regulations, pertaining to the determination of inactivity of a planned unit development, all of which is more particularly described herein. (Proposal No. 2016Z-011TX-001). The Planning Commission recommended withdrawal. Ms. Mina Johnson moved to withdraw the bill, which motion was seconded and adopted by a voice vote of the Council.
An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from AR2a to IWD zoning for property located at 3920 Stewarts Lane, approximately 3,580 feet south of Ashland City Highway and partially located within the Floodplain Overlay District (10.0 acres), all of which is described herein (Proposal No. 2014Z-049PR-001). The bill was approved by Planning Commission. Ms. Hurt moved to defer the bill to the December public hearing, which motion was seconded and approved by a voice vote of the Council.
An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by amending the Sharondale Drive Specific Plan District for various properties located along Sharondale Drive, Sharondale Court, and Sharon Hill Circle between Woodlawn Drive and Hillsboro Pike (29.44 acres) to clarify the measurement of maximum height for new buildings, all of which is described herein (Proposal No. 2007SP-065-001). The bill was approved by the Planning Commission. Mr. Pulley requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and no one came forward to be heard. The President declared the public hearing closed. Mr. Pulley moved to defer the bill indefinitely, which motion was seconded and approved by a voice vote of the Council.
An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from RS40 to CL zoning for properties located at 7330, 7340, 7350, 7360 and 7368 Whites Creek Pike, at the northeast corner of Whites Creek Pike and Interstate 24 (8.82 acres), all of which is described herein (Proposal No. 2016Z-064PR-001). The bill was disapproved by Planning Commission. Mr. Leonardo moved to defer the bill to the January public hearing, which motion was seconded and approved by a voice vote of the Council.
An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R20 to RS20 zoning for various properties located on Woodlawn Drive, Lynnbrook Road, and Bowling Avenue, east of Wilson Boulevard, (22.86 acres), all of which is described herein (Proposal No. 2016Z-106PR-001). The bill was approved by the Planning Commission. Ms. Mina Johnson moved to defer the bill to the December public hearing, which motion was seconded and approved by a voice vote of the Council.
An ordinance amending Metropolitan Code of Laws Chapters 17.04, 17.08, 17.16, and 17.40 pertaining to telecommunication facility uses and Section 6.26.350 to insert therein a reference to Chapter 17.16. (Proposal No. 2016Z-019TX-001). The bill was approved by the Planning Commission with a substitute. - CONSENT AGENDA RESOLUTIONS –
A resolution approving a memorandum of agreement between Access Fiber Group, Inc. and The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Historical and Historic Zoning Commissions, for the commissioning of an Economic Impact Study and a monetary contribution for the purchase of a historical marker at Fort Nashborough. The resolution was approved by the Budget and Finance and Planning, Zoning, and Historical Committees.
A resolution authorizing the execution and delivery of an economic development incentive grant agreement between The Metropolitan Government of Nashville and Davidson County and The Country Music Film Project, LLC/WETA. The resolution was approved by the Budget and Finance Committee.
A resolution appropriating $30,000 through a grant contract with Oasis Center, Inc. for the provision of services that help youth grow, thrive and create positive change in their lives and our community. The resolution was approved by the Budget and Finance Committee.
A resolution accepting a grant from Oasis Center, Inc., to The Metropolitan Government of Nashville and Davidson County, acting by and through the Davidson County Juvenile Court, for the implementation of Tennessee Wyman’s Teen Outreach Program as a part of the probation services in order to decrease risky behaviors and increase life skills among youth. The resolution was approved by the Budget and Finance Committee.
A resolution accepting a grant from the State of Tennessee, Administrative Office of the Courts, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Davidson County Juvenile Court, to provide mediation services for low income and indigent self-represented litigants with child access and visitation issues in Juvenile Court at off-site locations. The resolution was approved by the Budget and Finance Committee.
A resolution appropriating $250,000 through a grant contract by and between The Metropolitan Government of Nashville and Davidson County, acting by and through the Nashville Public Library, with Oasis Center, Inc. to provide college access services for the Nashville Scholars Program. The resolution was approved by the Budget and Finance and Parks, Library, and Recreation Committees.
A resolution accepting a grant from Tennessee Woman’s Suffrage Monument, Incorporated to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Parks and Recreation, for the reimbursement of costs associated with the temporary and permanent installation of the Tennessee Woman Suffrage Monument in Centennial Park. The resolution was approved by the Budget and Finance and Parks, Library, and Recreation Committees.
A resolution accepting a grant from the Friends of Shelby Park and Bottoms to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Nashville Parks and Recreation Department, to provide funding for a drinking fountain at the Cornelia Fort Trailhead. The resolution was approved by the Budget and Finance and Parks, Library, and Recreation Committees.
A resolution approving a contract between The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, and the Nashville Academy of Medicine to provide access to the Charisma Salus database system for patient tracking and prescription tracking. The resolution was approved by the Budget and Finance and Health, Hospitals, and Social Services Committees.
A resolution confirming the appointment of Nick Leonardo as the Metropolitan County Council representative to the Quality Assurance Committee for the Bordeaux Long Term Care facility as operated by LP North Nashville, LLC, a subsidiary of Signature Healthcare, LLC. The resolution was approved by the Health, Hospitals, and Social Services Committee.
A resolution approving an amendment to and assignment of a parking agreement between the Metropolitan Government and Stahlman Redevelopment Partners, LLC for the use of parking spaces for a fee in the courthouse parking garage to extend the expiration of the term of that agreement from 2046 to 2053 (Proposal No. 2016M-032PR-001). The resolution was approved by the approved by Planning Commission, Budget and Finance, Planning, Zoning, and Historical, and Traffic, Parking, and Transportation Committees.
A resolution approving a license agreement between the Metropolitan Government of Nashville and Davidson County, acting by and through the Nashville Farmers’ Market, and the State of Tennessee, Department of General Services, for parking spaces (Proposal No. 2016M-031PR-001). A resolution urging Live Nation Entertainment to take measures to ensure the equitable distribution and availability of tickets and to implement anti-scalping controls for events conducted at Ascend Amphitheater in Nashville & Davidson County. The Convention, Tourism, and Public Entertainment Facilities Committee recommended a two meeting deferral. The President announced that there are two vacancies on the Community Education Commission to be filled by election of the Council. Nominations must be filed with the Metropolitan Clerk not later than 4:00 pm on Tuesday, November 15, 2016. Nominees will be referred to the Rules-Confirmations-Public Elections Committee for a recommendation, and an election will be conducted at the December 6, 2016 meeting of the Council.
