ORDINANCE NO. BL2016-420

An ordinance approving the First Amendment to the License and Lease Agreement between the Metropolitan Government of Nashville and Davidson County, acting by and through its Parks and Recreation Board, and Nashville Hockey Club Limited Partnership (Proposal No. 2016M-030PR-001).

WHEREAS, The Metropolitan Government of Nashville and Davidson County (“Metro”) owns and through the Department of Parks and Recreation (“Parks”) operates Centennial Sportsplex (“Sportsplex”); and,

WHEREAS, Metro and Nashville Hockey Club Limited Partnership (“NHCLP”) are parties to the License and Lease Agreement dated October 1, 1998, as authorized by Ordinance No. O96-428 and more fully described in Exhibit A, attached hereto and incorporated herein by reference (the “License Agreement”); and,

WHEREAS, Metro and NHCLP desire to add Section 5.10 to the License Agreement, with the language in Exhibit B, attached hereto; and,

WHEREAS, said License Agreement Amendment has been approved by the Board of Parks and Recreation; and,

WHEREAS, it is to the benefit of the citizens of The Metropolitan Government of Nashville and Davidson County that amendment one be accepted.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the First Amendment to the License Agreement entered into between the Metropolitan Government of Nashville and Davidson County, acting by and through its Parks and Recreation Board, and Nashville Hockey Club Limited Partnership, a copy of which is attached hereto as Exhibit B and incorporated herein, is hereby approved, and the Director of Public Property is authorized to execute the same.

Section 2. This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
