Metropolitan Council Meeting

The Metropolitan Council met in regular session on this date at 6:30 p.m. in the Metropolitan Courthouse.

The invocation was offered by Bishop Marcus Campbell of Mount Carmel Missionary Baptist Church.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

The Minutes of the regular meeting of September 6, 2016 were approved.

- ELECTIONS AND CONFIRMATIONS -

Metropolitan Nashville Airport Authority
Appointment of Mr. John Doerge for a term expiring April 5, 2020. Mr. Doerge will fill the unexpired term of Ms. Debbie Wright. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Metropolitan Auditorium Commission
Appointment of Ms. Alice Chapman for a term expiring June 30, 2018. Ms. Chapman will fill the unexpired term of Ms. Elise Tyler. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Gas/Mechanical Examiners Appeals Board
Reappointment of Mr. Harold Ferguson for a term expiring August 21, 2020. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Reappointment of Ms. Lynn Taylor for a term expiring August 21, 2020. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Property Standards and Appeals Board
Appointment of Mr. Roger Ligon for a term expiring August 6, 2020. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Reappointment of Mr. Jim Massey for a term expiring August 21, 2020. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Appointment of Ms. Stephanie Soper for a term expiring July 29, 2020. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Solid Waste Regional Board
Appointment of Ms. Dinah Turner for a term expiring December 15, 2018. Ms. Turner will fill the unexpired term of Ms. Anna Alexander. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Health and Educational Facilities Board
The President announced that after further review, there is only one vacancy at this time. The President called for nominations to fill one vacancy for a six-year term ending September 30, 2022. Mr. Pulley nominated Mr. Stephen Meyer; Ms. Blalock nominated Mr. Thomas C. Weber; Ms. Hurt nominated Ms. Jennifer Douglas. There being no further nominations, the President declared the nominations closed. The nominees were referred to the Rules, Confirmations, and Public Elections Committee for recommendation and an election will be conducted on October 4, 2016.

- CONSENT AGENDA RESOLUTIONS –

RESOLUTION NO. RS2016-371

A resolution authorizing the Director of Public Property, or his designee, to exercise an option to purchase a portion of real property (Map 092-08-0 Parcels 106.00 & 107.00) for the use and benefit of the Metropolitan Nashville Public Schools (Proposal No. 2016M-023PR-001). The resolution was approved by the Planning Commission, Budget and Finance, Education, and Planning, Zoning, and Historical Committees.

RESOLUTION NO. RS2016-372

A resolution approving Amendment Five to a grant from the State of Tennessee, Department of Human Services, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Davidson County Juvenile Court, to establish and enforce federal and state mandated child support program guidelines for children born out of wedlock. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2016-373

A resolution approving the First Amendment to the Lease Agreement for Fire Station 20 between The Metropolitan Government of Nashville and Davidson County, acting by and through the Nashville Fire Department, and Southern Land Commercial Construction, LLC (Proposal No.2016M-024PR-001). The resolution was approved by the Planning Commission, Budget and Finance, Public Safety, Beer, and Regulated Beverages, and Planning, Zoning, and Historical Committees.

RESOLUTION NO. RS2016-374

A resolution accepting a grant from the State of Tennessee, Department of Transportation, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Davidson County Sheriff’s Office, to reduce litter along county, state, and interstate highways within the Metropolitan Nashville - Davidson County area. The resolution was approved by the Budget and Finance and Public Safety, Beer, and Regulated Beverages Committees.

RESOLUTION NO. RS2016-375

A resolution authorizing the Mayor of the Metropolitan Government of Nashville and Davidson County to execute a letter to the Tennessee Emergency Management Agency confirming the acceptance of an award to Homeland Security District 5 from the FY2016 Homeland Security Grant Program to provide core homeland security assistance to build capabilities at the State and local levels. The resolution was approved by the Budget and Finance and Public Safety, Beer, and Regulated Beverages Committees.

RESOLUTION NO. RS2016-376

A resolution amending Resolution No. R90-1136, pertaining to the creation and membership of the Community Corrections Advisory Board for Davidson County. The resolution was approved by the Public Safety, Beer, and Regulated Beverages and Rules, Confirmations, and Public Elections Committees.

RESOLUTION NO. RS2016-379

A resolution authorizing RSF Investors, LLC dba Rippys Bar & Grill to construct and install an aerial encroachment at 419 Broadway (Proposal No.2016M-024EN-001). The resolution was approved by the Planning Commission, Planning, Zoning, and Historical, and Public Works Committees.

RESOLUTION NO. RS2016-383

A resolution to honor Captain Tom Ryman on his 175th birthday and proclaim October 12, 2016 as Captain Tom Ryman Day in Nashville. The resolution was approved by the Rules, Confirmations, and Public Elections Committee.

RESOLUTION NO. RS2016-384

A resolution recognizing October 2016 as Domestic Violence Awareness month. The resolution was approved by the Rules, Confirmations, and Public Elections Committee.

RESOLUTION NO. RS2016-385

A resolution recognizing Fisk University Jubilee Day on the occasion of their Sesquicentennial. The resolution was approved by the Rules, Confirmations, and Public Elections Committee.

RESOLUTION NO. RS2016-378

A resolution approving a memorandum of agreement between Access Fiber Group, Inc. and The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Historical and Historic Zoning Commissions, for the commissioning of an Economic Impact Study and a monetary contribution for the purchase of a historical marker at Fort Nashborough. The resolution was approved by the Budget and Finance Committee; the Planning, Zoning, and Historical Committee recommended a two meeting deferral. Mr. Cooper moved to defer the resolution to the second meeting in October, which motion was seconded and approved by a voice vote of the Council.

RESOLUTION NO. RS2016-380

A resolution providing for stakeholder collaboration for purposes of entering into an industry-wide memorandum of understanding to upgrade Nashville’s permitting and make-ready process and shorten the timeline for deployment of broadband in Nashville. Ms. Weiner offered a substitute resolution and moved that it be accepted for filing and which motion was seconded and adopted by a voice vote of the Council.

SUBSTITUTE RESOLUTION NO. RS2016-380

A resolution requesting stakeholder collaboration for purposes of entering into an industry-wide memorandum of understanding to upgrade Nashville’s permitting and make-ready process and shorten the timeline for deployment of broadband in Nashville. The resolution was disapproved by the Budget and Finance and Public Works Committees. Ms. Weiner moved to adopt the resolution, which motion was seconded. RESOLUTION NO. RS2016-381

A resolution requesting that the Tennessee Department of Transportation prioritize certain projects within Metropolitan Nashville and Davidson County. The Traffic, Parking, and Transportation Committee recommended deferment. Mr. Pulley moved to defer the resolution, which motion was seconded and approved by a voice vote of the Council.

RESOLUTION NO. RS2016-382

A resolution urging Live Nation Entertainment to take measures to ensure the equitable distribution and availability of tickets and to implement anti-scalping controls for events conducted at Ascend Amphitheater in Nashville & Davidson County. The Convention, Tourism, and Public Entertainment Facilities Committee recommended a three meeting deferral. Mr. Shulman moved to defer the resolution to the first meeting in November, which motion was seconded and approved by a voice vote of the Council.

Without objection, the rules were suspended for consideration of one (1) late resolution.

RESOLUTION NO. RS2016-386

A resolution accepting a grant from the Robert Wood Johnson Foundation in conjunction with KaBOOM!, Inc., to The Metropolitan Government of Nashville and Davidson County, acting by and through the Mayor’s Office of Neighborhoods and Community Engagement, to make play easy, available, and fun for all kids and families. The resolution was approved by the Budget and Finance Committee. An ordinance amending Title 2 of the Metropolitan Code pertaining to the electronic formatting and online posting of reports regularly submitted to the Metropolitan Council by the various departments, boards and commissions of The Metropolitan Government of Nashville and Davidson County. Upon motion duly seconded, the bill passed first reading and was referred to the Rules, Confirmations, and Public Elections Committee by a voice vote of the Council.

BILL NO. BL2016-417

An ordinance amending Section 12.40.150 of the Metropolitan Code to prohibit the display of vehicles for sale upon residential properties fronting arterial streets. Upon motion duly seconded, the bill passed first reading and was referred to the Codes, Fair, and Farmers Market Committee by a voice vote of the Council.

BILL NO. BL2016-418

An ordinance to amend Ordinance No. BL2016-343 regarding "one touch make ready" by adding a requirement for an attacher to hold the Metropolitan Government harmless under certain circumstances. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance and Public Works Committees by a voice vote of the Council.

BILL NO. BL2016-419

An ordinance requiring members of the Metropolitan Council and other Davidson County elected officials to receive diversity training through the office of the Metropolitan Department of Human Resources. Upon motion duly seconded, the bill passed first reading and was referred to the Personnel, Public Information, Human Relations, and Housing Committee by a voice vote of the Council.

BILL NO. BL2016-420

An ordinance approving the First Amendment to the License and Lease Agreement between the Metropolitan Government of Nashville and Davidson County, acting by and through its Parks and Recreation Board, and Nashville Hockey Club Limited Partnership (Proposal No. 2016M-030PR-001). An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon approximately 95 linear feet of 12 inch sewer main, approximately 12 linear feet of 18 inch sewer main, approximately 235 linear feet of 24 inch sewer main and to accept approximately 96 linear feet of 30 inch public sewer main, approximately 176 linear feet of 24 inch public sewer main, approximately 37 linear feet of 24 inch public sewer main, and any associated easements on property located at 901 Woodland Street (MWS Project No. 15-SL-189 and Proposal No. 2016M-040ES-001). The bill was approved by the Planning Commission. BILL NO. BL2016-426

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon an existing water main and fire hydrant and to accept public sewer main, three man holes, water main and one fire hydrant assembly, and any associated easements, located at 601 11th Avenue North (MWS Projects No. 16-WL-008 and 16-SL-0013 and Proposal No. 2016M-036ES-001). The bill was approved by the Planning Commission. BILL NO. BL2016-427

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon approximately 410 linear feet of three inch water main and approximately 370 linear feet of four inch water main and to accept approximately 780 linear feet of eight inch public water main and fire hydrant, for property located at 20 Rutledge Street (MWS Project No. 16-WL-110 and Proposal No. 2016M-041ES-001). The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Planning, Zoning, and Historical and Public Works Committees by a voice vote of the Council.

BILL NO. BL2016-428

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from IWD to MUN-A zoning for properties located at 1333 and 1335 Baptist World Center Drive, at the northeast corner of Weakley Avenue and Baptist World Center Drive (0.31 acres), all of which is described herein (Proposal No. 2016Z-057PR-001). The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Planning, Zoning, and Historical Committee by a voice vote of the Council.

BILL NO. BL2016-429

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from IWD to MUN-A zoning for properties located at 1109 and 1111 Baptist World Center Drive, at the northeast corner of Willis Street and Baptist World Center Drive (0.44 acres), all of which is described herein (Proposal No. 2016Z-058PR-001). The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Planning, Zoning, and Historical Committee by a voice vote of the Council.

- BILLS ON SECOND READING -

BILL NO. BL2016-302

An ordinance granting a franchise to TN Backhaul Networks, LLC, to construct, operate, and maintain a telecommunications system within Metropolitan Nashville and Davidson County under the provisions of Metropolitan Code of Laws, Title 6, Chapter 26 (Proposal No. 2016M-001FR-001). The Budget and Finance approved an amendment to the bill and recommended to defer two meetings and re-refer the bill with a requested special joint committee meeting. The Planning, Zoning, and Historical and Public Works Committees recommended a two meeting deferral. Ms. Gilmore moved to defer the bill to the second meeting in October and requested a joint committee meeting, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2016-336

An ordinance to allow a local business preference on competitive bidding and to allow matching of low bids. The Budget and Finance Committee recommended deferment. Mr. Glover moved to defer the bill to the second meeting in September, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2016-375

An ordinance to amend Chapter 6.28 of the Metropolitan Code pertaining to the maximum occupancy of Short Term Rental Property. The Codes, Fair, and Farmers Market and Convention, Tourism, and Public Entertainment Facilities Committees approved an amendment and requested a two meeting deferral with re-referral to the committees. Mr. Mendes offered Amendment No. 1 and moved for its adoption, which motion was seconded and adopted by a voice vote of the Council. Mr. Mendes moved to defer the bill as amended to the second meeting in October and re-refer the bill to the Codes, Fair, and Farmers Market and Convention, Tourism, and Public Entertainment Facilities Committees, which motion was seconded and approved by a voice vote of the Council with Ms. Roberts abstaining.

BILL NO. BL2016-377

An ordinance to amend Title 13 of the Metropolitan Code of Laws by adding a new chapter to require utility companies to give written notice to property owners within six hundred feet of any utility work or maintenance that requires vegetation trimming or disrupts vehicular or pedestrian traffic. The Public Works Committee recommended deferment. Mr. Glover moved to defer the bill indefinitely, which motion was seconded and approved by a voice vote of the Council.

An ordinance to amend Chapter 6.28 of the Metropolitan Code pertaining to Short Term Rental Property (STRP). Ms. Allen offered a substitute ordinance and moved that it be accepted for filing and which motion was seconded and adopted by a voice vote of the Council.

Mr. O’Connell moved to pass the bill on second reading, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2016-384

An ordinance abolishing the alarm appeals board created by enactment of Ordinance No. O91-1523, by amending Chapters 10.60 and 6.64 of the Metropolitan Code of Laws pertaining to alarm systems and commercial solicitors. The bill was approved by the Public Safety, Beer, and Regulated Beverages and Rules, Confirmations, and Public Elections Committees. Mr. Shulman moved to pass the bill on second reading, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2016-385

An ordinance requiring members of the Metropolitan Council and other Davidson County elected officials to receive training regarding sexual harassment awareness and prevention through the office of the Metropolitan Department of Human Resources. The bill was approved by the Personnel, Public Information, Human Relations, and Housing Committee. Ms. Weiner moved to pass the bill on second reading, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2016-386

An ordinance providing the honorary designation of “Reverend Curtis W. Goodwin, Sr. Way” for Horton Avenue between 12th Avenue South and 15th Avenue South. The bill was approved by the Public Works Committee. Mr. Sledge moved to pass the bill on second reading, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2016-387

An ordinance approving a contract by and between The Metropolitan Government of Nashville and Davidson County, acting by and through the Mayor’s Office of Economic Opportunity and Empowerment, and the United Way of Metropolitan Nashville to provide one-on-one financial counseling and other financial education activities at no charge to low income residents in accordance with the Financial Empowerment Center program model. The bill was approved by the Budget and Finance Committee. Mr. Cooper moved to pass the bill on second reading, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2016-388

An ordinance approving the conveyance of two adjacent parcels of property to The Health and Educational Facilities Board of the Metropolitan Government of Nashville and Davidson County, Tennessee to be used for a multifamily residential development project, 40% of which will be subject to low income housing tax credit requirements, and authorizing and directing the Board’s entry into an agreement providing for payments in lieu of ad valorem taxes on the project site (Proposal No. 2016M-025PR-001). The bill was approved by the Planning Commission and Planning, Zoning, and Historical Committee. The bill was approved by the Budget and Finance Committee with a request for re-referral to the committee. Mr. Cooper moved to pass the bill on second reading and re-refer the bill to the Budget and Finance Committee, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2016-389

An ordinance to amend the Geographic Information Systems Street and Alley Centerline Layer for the Metropolitan Government of Nashville and Davidson County, by changing the name of a portion of Buchanan Street to “Delta Ave” (Proposal Number 2016M-002SR-001).
