ORDINANCE NO. BL2016-427

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon approximately 410 linear feet of three inch water main and approximately 370 linear feet of four inch water main and to accept approximately 780 linear feet of eight inch public water main and fire hydrant, for property located at 20 Rutledge Street (MWS Project No. 16-WL-110 and Proposal No. 2016M-041ES-001).

WHEREAS, the abandonment of approximately 410 linear feet of three inch existing water main and approximately 370 linear feet of four inch water main and the acceptance of approximately 780 linear feet of eight inch public water main and fire hydrant, for property located at 20 Rutledge Street, are needed to construct project No. 16-WL-110; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2016M-041ES-001 on August 17, 2016 for the abandonment and acceptance of said water main and fire hydrant.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 410 linear feet of three inch existing water main and approximately 370 linear feet of four inch water main and to accept approximately 780 linear feet of eight inch public water main and fire hydrant, for property located at 20 Rutledge Street, as shown below and on Exhibit 1, which is attached hereto and incorporated by reference:

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
