RESOLUTION NO. RS2016-373

A resolution approving the First Amendment to the Lease Agreement for Fire Station 20 between The Metropolitan Government of Nashville and Davidson County, acting by and through the Nashville Fire Department, and Southern Land Commercial Construction, LLC (Proposal No.2016M-024PR-001).

WHEREAS, The Metropolitan Government of Nashville and Davidson County (“Metro”) owns the property at 2025 Richard Jones Road, known as Fire Station 20; and,

WHEREAS, Metro and Southern Land Commercial Construction, LLC (“SLC”) are parties to the Lease dated February 15, 2014, as authorized by BL2014-700 and more fully described in Exhibit A, attached hereto and incorporated herein by reference (the “Lease”); and,

WHEREAS, the Parties desire to amend the Lease to provide that the Permitted Use, as set forth
in the Lease, shall include exclusive use of all of the real property and improvements located at
2025 Richard Jones Road, Nashville, Tennessee (the "Property"); and,

WHEREAS, it is to the benefit of the citizens of The Metropolitan Government of Nashville and Davidson County that amendment one be accepted.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That this Amendment to the Lease entered into between the Metropolitan Government of Nashville and Davidson County, acting by and through the Nashville Fire Department, and Southern Land Commercial Construction, LLC, a copy of which is attached hereto as Exhibit B and incorporated herein, is hereby approved, and the Director of Public Property is authorized to execute the same.

Section 2. This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
